the story of his wall shifting to the Project Manager. His wall had been built in 2007 and had a 5 year warranty. The warranty had already expired when the homeowner came in, and he was aware that he would be charged to have the wall fixed by us or any other company. He was then told by the Project Manager that we could not get to him to service his wall as we were booked solid with work. At that time the homeowner should have moved on and chosen another contractor if he was in need to get it donebefore having his driveway done. Seems to be faulty scheduling done on the homeowners part. Any of the phone calls or email that were made or sent are unknown as the company now has different staff. We have no record of calls or emails. Also, in the complaint the homeowner said he had spoke to the owner of the company. I’ve confirmed that with the owner of our company and he said he never talked to the homeowner at all.
Review: In August 2014 we had a koi pond and waterfall reconstructed in the amount of $8,200.00. From the onset, the pond was losing water. The owner, Robert B[redacted] Sr., told me we had to wait until after the winter to see which was leaking, the waterfall or the pond itself. He said if the water level held, then we know it would be the waterfall which was leaking. In spring 2015, I turned on the waterfall and told Bob the waterfall was leaking, burning out the pump which he did replace. So much water was leaking from the waterfall that it lifted the liner and box filter out of the ground. Since then I have asked him repeatedly to come and repair the waterfall. He has made several excuses and now tells me that he will have to charge me $70.00/hour/man plus a machine fee to repair it, even though he did not use a machine when it was initially installed.Desired Settlement: I would like the waterfall repaired at no additional cost since it was not installed correctly

Response:
We will be getting in touch with Mr. [redacted] to have company a representative review the waterfall area to identify the problem area and repair if it's a problem due to the installation. Our records indicate that a representative came to the house last year to review the water feature after Mr [redacted] stated that water was traveling under his liner and lifting the liner. We found that since the pond installation a downspout from the house was redirected and allowing rain water to travel to the pond area which would of caused the liner to lift. This is evident as is would take a much greater capacity of water to lift the liner then what the pond holds. We will be in touch with Mr. [redacted]l within the next two weeks to have a representative come to the house to review the area amicably.Thank you,Jeff B[redacted], President

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me.
Review: The company installed a retaining wall in driveway in 2007. They really wanted our business and were willing to stand behind their work at that point. Subsequently, our wall has shifted. We needed to get the issue resolved this year because of a new driveway being laid.. We started the process by contacting the company in May of this year, fully understanding that we were beyond the original warranty or guarantee. All we were asking for was some help to correct the situation. Since May, there have been numerous phone calls and e-mails to them. NONE were returned!!!!! On September 15th, out of frustration with the lack of responses to our calls and e-mails, I went to their office and was treated rudely like I was trying to cheat them, even though I had tried at least 7 or 8 times to resolve this situation. The company representative (the owner) said that he didn't remember our work and was indignant that I questioned their work. Never the courtesy of a phone call to respond to me. The company representative had numerous excuses for their failures in communication, even suggesting that we did concrete work following their installation ( none of this was accurate). After an hour of deliberation, they strongly suggested that we go to another contractor to solve our problem. Is this the way to treat a responsibly paying customer? What happened to customer courtesy?Desired Settlement: First, an apologetic phone call would help to at least try to correct the communication issue. Secondly, we do not expect a full refund, but at least something to cover labor charge for a contractor that we had to scramble to get in less than a week because of our new driveway being installed the week of September 22nd.
