Review: We hired [redacted] of Pi Scean Associates to rebuild a fish pond. The deal was to have this completed before Mother's Day, to which My. [redacted] agreed to. Work commenced 3-4 weeks prior to Mother's Day. The existing pond liner was removed, additional pond installed along with waterfall. The fish pond is defective as it leaks into the surrounding earth. The liner of the upper pond and spillway to the lower pond was not installed properly and is the source of the leaks. This problem was brought to the attention of **. [redacted] who attempted to fix the problem by adding additional mortar on the outside of the pond, but since the liner is not installed properly, it had no effect. **. [redacted] did not complete the job for which he was hired and I had to complete the job by installing the correct type of water pump. He was paid $1500 for a defective job. The pond loses 9" - 12" of water in a 24 hour period.

I had another pool contractor (Garden Pond Service, Barto PA) assess the situation and they discovered the sources of the leaks (more than one) and stated that the waterfall, upper pond and spillway need to be demolished with liner removed so that a new liner can be installed correctly.Desired Settlement: We are seeking a complete refund for the job as it has to be removed and reinstalled correctly.

I am rejecting this response because: [redacted]'s response is grossly inaccurate. I did excavate the additional pond hole with my tractor, to the dimensions and depth specified. I have pictures to prove it. The stones were available, as agreed, but it was apparent that we did not have enough stone work and [redacted] obtained more. There were some changes made to the pool design, mainly for stone look. The fountain was added, but at no time did [redacted] indicate that this would affect the required completion date of May 16th. He started on April 12th and told me that it should be done in one - two weeks. He knew the importance of the completion date, yet never managed our expectations. However, my complaint is not about missing the completion date. It's about a defective pond. It leaks. Period. The liner was not installed properly and is simply missing in certain areas, which is where the water is escaping from.

When I first pointed out the leak problem, [redacted] responded by trying to plug the "gap" of no liner with concrete. That's not a workable solution and did not fix the leak. I lose about 4 - 6 inches of pond water each day and must manually fill it up to the correct height. I have pictures of where the liner is completely missing and causing the problem at hand.

Once [redacted] was paid the initial $1500, he stopped coming to the job with any regularity. He was paid about 10 days before we needed the job completed, then skipped many days by not showing up. He could have obtained a pump from another source, but chose to blow us off. Again, this is an annoyance, not the crux of the problem. Pond is defective due to shoddy and unprofessional construction.

I am rejecting this response because: Pool guy's facts are askew. This issue is not about a pond spec or removing dirt. We were disappointed that pool guy stopped coming to work on pond with any regularity once paid, though he did open pool. He came and left for the pool opening contract (and was paid for that contract), but neither offered to complete pond, nor make any arrangements to complete it. I don't need to debate that any further as it's not germane to the problem at hand.

Yes, pool guy attempted to correct leak with concrete against a vinyl liner. He jammed some concrete into the area that the supply entered the upper pond. That is not a workable solution since vinyl is a soft substance and will expand/contract at different rates than concrete. The vinyl liner did not extend to the top of the pond, therefore the supply line to the upper pond ran outside of the liner itself and provided a means for the water to escape. You can't have a pond with a supply liner below water grade and not expect the water to leak out from that location. I've had quotes from other pond companies and both independently found the source of the leaks. The problem goes beyond the leak at the supply line. We are not interested in pool guy attempting a repair any longer. He has not instilled a level of confidence in his abilities in building ponds that don't leak.

If pond guy is willing to refund our $1500 investment, we are willing to drop the suit. The suit reflects the cost to have another company come in, demolish the defective work, and rebuilt it properly.
