Please accept the below as our company's formal response to Complaint # [redacted] Our company, Permanent Painting of NJ LLC, was hired to paint the exterior of the claimant's home and our company began work on July 10, The claimant was out of state and his property unoccupied in the weeks prior to our arrival and all through out the duration of our services which commenced on July 25, with the exception of painting the front door to which we needed someone to open in order to paintWe returned on July 30, and completed the front door as promised, and documented attached.A managing member of our company was on site every day throughout the process and performed service work.The complaint statement that our company removed leaders and window well covers from "the entire house and did not replace" is inaccurate I have attached for your review photo graphs with origination dates that we sent to the complaint-ant during our job progress, also documented in the attached email correspondence The images, taken on July 14, clearly show the preparation process of sanding the house down and gutters and leaders are in place In addition, the image of the side of the home with the windows masked off, clearly show that it had rained, again with gutters and leaders in placeThe only time we remove leaders or any debris well covers, is to paint behind them The painting process does not take place until prep work is complete Furthermore, we can not and do not prime or paint when it is rainingWe completed prep and began painting on Monday July 21, and the only day it rained during that process was on July 23, in the evening a total amount of inches This is hardly enough to cause this type of damage mentioned in the claim.The claimant notified us via email on July 28, after we had finished the job on July 25, that "he just got a call from his daughter saying there was water in the basement and placed fault on our companyWe immediately notified our insurance carrier and turned it over to them to investigate, which is proper procedure.The claim states "The total out of pocket cost was $27,we can supply invoices"The only invoices supplied to the insurance company during the claim process are as follows; invoice from Rainbow Remediation in the amount of $5,138.44, an estimate from [redacted] in the amount of $5,and an invoice from [redacted] for carpentry and painting in the amount of $3,There has been no documented listing or value of personal property damaged ever supplied by claimant.The complainant filed a claim with our insurance company and I have attached copies of the correspondence sent to him on behalf of [redacted] our insurance company His claim was denied, as was his claim with his homeowners, due to ground water intrusion He did not request a review of the findings or pursue an appeals as available to him through [redacted] on the attached letter Furthermore, there was nobody home to account for the exact date or time of the water intrusion.He has since filed a credit card dispute with [redacted] to which was preliminary closed in our favor, then mysteriously reversed and granted to him without any investigation through the insurance companies and their reports or findingHe has been issued $10,back from us through ***.The fact of the matter is that there is no proof or witness to support this claim as his home was unoccupied and unattended Both he and his wife were out of the state The attached rainfall totals, easy researched on the internet, show a heavy amount of rain on July 3, 2014- inches of rain- there is no evidence that the water damage did not happen then, before our company ever arrived at the property.This situation is currently in the hands of the attorneys and the insurance companies and there is no evidence this damage was a result of our company's services or liabilities We have been advised that all correspondence with the claimant must go through the insurance companies and attorneys.Please confirm receipt of our response above regarding this complaint.Sincerely,

I am rejecting this response because: As the reponse will be lengthy with a lot of backup, we will forward its entirety via *** in the next two days.The nature of our complaint is breach of contract and negligenceWe signed a contract with Permanent to paint the outside of our houseThey used a subcontractor (*** to perform the work without our knowledge, without our permission, and without mention in the contractHad we known their intention we would not have used them.We were away during the work but had someone regularly checking the house (see *** email)During the work the leaders and window well covers were removedThere were a number of rain days when the crew did not showIn the area affected (not in Permanent's pictures) when it rained, all the water pours off the back roof, down the side of the house into the wells forced the window open and flooded the basement...see *** *** report, see email of responsibility from Permanent to insurer,see C *** email.We will also include in our package photos of damage, verification of *** *omplant and Permanent's knowledge and response.Thank you.Sincerely*** ***

Review: This past summer I signed a contract for Permanent Painting to paint the exterior of my home. Unbeknownst and not authorized by me, Permanent Painting hired a subcontractor to do the work. If I had known this, I would never have agreed for them to do the job.
While the subcontractor was doing the painting (my wife and I were away) the leaders and window well covers were removed from the entire house and were not replaced. The completion was delayed due to heavy rain a number of days. During one of the rainfalls water poured off the roof, filled up the window well, forced the window open and thereby caused considerable flooding in our basement. We had to hire a contractor to dry it out, perform mold remediation though out, and remove all the damaged carpeting , furniture, etc. Then we had to repaint, replace the damaged walls, recarpet etc. The total out of pocket cost was $27,000. Permanent has refused to settle the claim with us. We can supply invoices.Desired Settlement: The cost of the painting was $14.0. I was able to recoup part of the cost of this claim by having [redacted] reverse and credit me for 10.0 of the 14.0 charged. Therefore, I am asking Permanent Painting to settle the balance of the claim..ie 27.0-10.0 or $17,000.
