he did not provide the dealership with the title or lien release on his trade in vehicle. Christopher's new vehicle had a temporary registration he was given for the Chevy, which is good in NY State for 45 Days - NOT the 10 days as he stated in his complaint. His registration was processed and ready at DMV on 1/**/16. We contacted Chris on numerous occasions to come pick up his new registration at the dealership and to drop off the title and lien release for his trade in vehicle. The dealership can not do anything with his trade until we had his title, and we asked that he drop it off ASAP and we would give him his registration for his new car at that time. He never responded to any of ou r calls and we waited for 3 weeks for the title to his trade. The day he finally called us upset he didn't have his registration, we again informed him to please bring the title and we would give him his registration at that time. He came the same day, made a scene with another customer in our parking lot, and then was rude and abusive to my DMV/Receptionist. At that point I told him he was not welcome here any more, as he is not to treat my employees and other customers the way he did. All of the customers concerns regarding the vehicle were addressed in our service department and we would be happy to provide copies of the repair orders if we can send them in. Please let us know and we will send right away. I have been in business for over 30 years and I have been a part of this community for over 20 years. I have never had to ask someone to not come back to my dealership.

we stood with the refund for [redacted]. The Warranty company informed us today 8/*/2016 that it may take up to 30 days for us to receive the check to give to [redacted] for her refund. The refund check should be here any day. Review: I purchased a vehicle from Performance and a day later it's had nothing but mechanical problems. Such as a Broken Anti Lock Breaking system wire and a continuous abs code on the dash, bad whole front hub assembly, needs wheels/steering alignment. And the rear drums grind. But the worst was it stalled on me at least once a day. All issues have been brought to owner [redacted] attention but so far front hub and abs problems have been fixed. The truck has been in an out of there shop multiple times and it's an inconvenience trying to find transport to work. I was lied to about had I was being Givin for my trade in. But I am at fault for signing before reviewing and I accept that. I fear physically going to performance because of the lies multiple lies from the owner receptionist, and 2 sale man . Ive been forced to document all conversations. Some of which prove the lies. while having a conversation about trying to resolve the situation completely Jacob stated "you don't have a leg to stand on, your not getting a dime from me" Jacob has threatened to cut my warranty in half. Recently he falsely accused me of slandering him and threatened me with his lawyer while I was at work. My registration was withheld at there shop almost a month after the temporary 10 day expired. Review: I bought a 2008 Mazda3 from performance beginning of June 2013. I had the vehicle for about 6 weeks, and was told I had to bring the car back because there was a problem with the financing company. I put a down payment of $1400 on the car and after being harassed to bring the car back, I figured that as long as they gave me my money back, I would go elsewhere. The owner told me on the phone to bring the car back and I would get my deposit back. When I got there, he drilled the plates off, ripped the registration off ( still temp after 6 weeks) and told me to give him the keys and I wasn't getting my money back. I ended up driving the car to the police station, only to be told that I have to file with small claims. They got the car back and now I'm out all that money.Desired Settlement: Although I put many miles on the car in a short period of time ( 6,000), it was my car and if I wanted to put 80,000 miles on it, I had the right. I would really like my $1400 deposit back that I paid in cash so I can get another car.

I am writing this letter in response to the complaint filed by [redacted].

This was an unfortunate circumstance that was brought on by the buyer and the parties involved on that side of the transaction. This all started at the end of May when a lady by the name of [redacted] came into Performance Motorcars looking to purchase

a vehicle. It was not till the first week of June that she decided she wanted the 2008 Mazda 3 mentioned in the complaint. We went ahead and attempted to obtain financing on her behalf, unfortunately credit issues would not allow for [redacted] to obtain financing. She brought us a Co-signer by the name of [redacted] to try to obtain the loan; although he had good credit standing financing

could not be obtained. A day or so later [redacted] came back to the dealership and asked us to try and obtain financing using the Co-signer ([redacted]) and her fiance, [redacted]. After attempting to obtain financing for [redacted] through several different banks,only I gave us an approval. We informed [redacted] that we got everything approved and she came in with [redacted] to get the car. After signing the papers we then had to send everything to [redacted] in Massachusetts, where he lives.

A couple weeks go by and the finance company calls [redacted] to ask ensure the address and loan information where correct, he then proceeds to tell the loan company that the car is not for [redacted] but for [redacted] and that [redacted] would not be paying the loan. At that point the bank decided they did not want to do business with the above mentioned parties. As a result of these events the bank did not pay us for the vehicle. I alerted [redacted] that the vehicle needed to be returned. She told me she was in Florida with the vehicle and I explained what the bank decided; she was very amicable and understood the situation. I was in contact with [redacted] about 15-20 times during the week she was in Florida via text and phone calls, all of which Istill have saved in my phone. In those conversations she agreed that we would give back $400 based on the fact that she put about 6,000 miles on the car. Upon inspecting the vehicle we realized the vehicle has 7,276 more miles, not 60001 1 have available all documentation showing the miles when bought the car and the miles when it was returned.

Let us now discuss the manner in which [redacted] decided to go about returning the car. After returning from Florida she kept

the car for 3 days because she felt uncomfortable with returning the earl Upon arriving at the dealership we wanted to inspect the vehicle for damage and mileage and she would not allow us to do so. We took the plates off the car figuring she would work with us and allow us to check the mileage; [redacted] then got in the car and sped off with no plates and no registration. At this point we were left with no option but to alert the police and report the vehicle stolen. The police officer we dealt with found that the vehicle was taken to a police station and surrendered; we then went and retrievedthe vehicle from the police that evening without incident.

Another point I'd like to make is why was it [redacted] that filed a complaint with the police when it was [redacted] that supposedly owned the vehicle?

That brings us to where we are today.

I would like to say that I am sorry for this unfortunate situation as there are no winners here. I am not in the business of selling and then taking cars back. I want all my customers to enjoy the vehicles they purchase. It is not my fault that the purchasers in this case where unable to keep their stories straight! Now I have a vehicle with 7,000+ miles more than it had when it was "purchased."

I have been in business for 28 years, 19 at this location. My rating with the Revdex.com is an A+ during that time; I don't think you achieve an A+ rating by being dishonest and stealing from customers.
