For your convenience I have attached the survey of the common property line showing Ms***'s drivewayThis survey was completed prior to demolition of this homeI have also
enclosed a larger scale version of our common area property line at front of our common lot line
As you can see from the larger scale drawing, Ms***'s stone curb that is common to our property line, is clearly encroaching upon on our property by approximately 4" and for a distance of +/- 30'
At Ms*** request we remove her stone curb which was likely installed by the previous owner of her homeAs a courtesy to Ms***, we agreed to remove the stone curb up to the point where it no longer encroached on our property at *** *** She understood that she would be responsible for any repairs needed to her driveway once the curb was removed
As we told Ms***, we did not remove the balance of the wall as it acts as a barrier to prevent water running on to her propertyShe requested removing the old wall and install a new wall on her propertyWe respectively declined her request
We immediately addressed Ms***'s runoff that occurred on 06/25/We cleaned the entire area, cleaned her 24' x 36" rug and installed additional siltation fencing and hayThe subsequent time we were contacted by Ms***, we arrived only to find no mud on her front porch
Upon recent inspection of Ms***'s driveway, the damage you are referring to can only occur after years of wear and happened well before our arrivalThis is not something that could be caused by construction on a neighboring lot and we have no intention of repairingMs***'s driveway was never accessed by any of our construction crewIn hindsight, the partial removed stone curb should not have been removedPrior to removal, no water or mud drained on to her propertyUnfortunately for us, no good deed goes unpunished
We have installed a new asphalt curb along *** *** This keeps water on the street as the prior curb didThis along with additional straw and siltation fencing is keeping the runoff to our propertyWhen weather allows, our property will be sodded and water will be controlled on our property
You may not realize that Ms***'s home along with the original home at *** was built in a sump conditionThis means that the home was built too low to the streetThis allows water to flow from the front yard directly into the home
The City of *** *** did not instruct Pentrex Development to construct to build a retaining wallThey know the wall is not on our propertyWe are not responsible to make improvements to areas outside of our property line
We will continue to monitor the drainage and I feel confident that the only water on Ms***'s property is coming from her front yard
At the beginning of construction, Mrs*** expressed her disappointment that she was unable to sell her home due to the abandoned home next to herShe was excited to learn of our plans for new construction in hopes that she could re-list her home once construction is completeI would have expected Mrs*** to be more grateful for these things we have done for her which would certainly aid in her attempt to sell her home
In addition to the above, we have provided Mrs*** with the following:
Removed & hauled off 24" tall x 60' long concrete wall & footing running from rear of driveway to rear of propertyCosting Pentrex Development $2,
Removed 12" tree & stump located on Ms***'s propertyThis cost to Pentrex was $
Grading & leveling of rear yard with dirt where 24" tall retaining wall once wasThe cost of this was $
Plans are to sod the disturbed areaWe anticipate this to cost $
Removed stone curb at front at a cost of $
Paid Ms*** $50/per month for months so we could use her electric to operate some small tools during the beginning of constructionThe total paid was $and I can guarantee that we did not use that amount of her electric service
