Penniston Fence was hired to move a fence we installed previous years earlier due to neighbor's (claimant) encroaching on the property by cutting down shrubs and planting new plants that were not on claimant's property Penniston Fence customer had survey done that clearly showed the property line being about 4' into neighbor's (claiments) new planting area Penniston Fence customer notified neighbor that fence was going to be moved to property line as well as additional footage of fencing installed Claimant had plants moved prior to fence installation.Due to StLouis County and Sunset Hills regulations the pickets of new fence had to face the neighbor's yard This requires for Penniston Fence to stand upon the neighbor's soil in order to erect and move existing fencing Therefore, we did have to stand upon the neighbor's soil for fence work but no shrubs or trees were destroyed by this activity We cut no trees down whatsoever in order to erect new fencing Did receive a phone call from neighbor notifying us of some dirt upon his driveway Told neighbor that we would blow off the entire driveway the next day-which we did
Once again I'll state that no plants were killed and that we did blow off entire driveway off any debris
Mr*** already had a deck installed prior to Penniston Fence being hired on April of 2015. Penniston Fence was hired to replace deck boards, install new railing and stairs. This is also why no permit was required for the deck repair. Alex *** was on the job
site each and every day. Final payment was made after deck work was completely finished and entire work inspected by Mr***. Prior to signing a contract with Penniston Fence the company owner explained the difference between using cedar, composite or pressure treated wood. It was clearly stated that pressure treated wood was by far the least expensive while also being the most prone to warping over time. It was strongly suggested to Mr*** that upon choosing pressure treated as his desired wood he should stain the entire deck in order to help prevent the aging issues

I am rejecting this response because: the business response does not address the complaint. I have pictures that verify that the mud was not cleaned off the driveway, plants broken due to their work, and I have a police report that supports the damage claims. Blowing off the driveway did not clean-off the driveway. They did not ask for nor did they receive permission to be on my property. They did not address any of the damage done by their work.
