Penn community bank is changing customers NSF fees of $35 when they have sufficient money in the account to cover the checks. I had $50 in the account and two checks out for $24 each ($48) and was charged two separate $35 fees 3 days after the checks were cashed. There was $1.93 in the account and still I got charged. They will not refund the $35 and said they will continue to charge my account until it is positive again.
January 3, 2020 Dear Ms. Stewart: The following is a summary of events covering the customer’s complaint. The customer wrote two separate $24.00 checks (109 &110) both payable to a *** that were originally submitted for payment on October 16th, 2019. At the time the checks were presented her balance was $1.11. Both checks were returned and she was charged a returned insufficient funds charge for each transaction. The bank refunded one of the charges. The same two checks were than resubmitted by the *** on November 8, 2019, paid and that left a balance of $1.93, as stated by the customer. On November 12th, the *** submitted two $50.00 ACH return fee withdrawals (for checks 109 & 110) against her account. Both were rejected and her account charged a $35.00 returned insufficient funds charge for each. One charge was reversed leaving a negative balance of ($33.07). I would assume the *** was charged by their bank for the original returned items and was trying to recover these fees. On November 18th, the *** again submitted two $50.00 ACH return fee withdrawals (109 &110) against her account. These were both rejected and her account charged two returned insufficient funds charges now leaving a negative balance of ($103.07). There were electronic conversations back and forth between the customer and our Branch Manager with the customer requesting the account be closed. On November 27th, the Bank reversed the two returned insufficient charges from November 18th and the remaining negative balance of ($33.07) was reversed to close out the account.
The charges against the customer’s account were the result of ACH return fee transactions from the ***, in which the Bank properly rejected and charged the customer’s account. The bank doesn’t owe the customer a refund since the account was at a negative balance and the fees were reversed to close the account.
