1.) crane was never mentioned in the beginning of job because it wasn’t planned on being neededThat’s why there was no up charge in contract when it was needed Deposits on jobs are taken in this industry to get on schedule and also to cover time and material in setting up jobSuck as renting tools necessary to complete them or cover man hours used to get job started like on this oneAs for knowing when a crane is needed on job.....this is sometimes hard to do until the tree is climbed and inspectedIn this industry every tree is a different size, shape, and in different locationTrying to distinguish the structural integrity of a dead tree from the ground is even harder.2.) There was no lie about refunding deposit at allThere’s proof of a partial deposit refund that the customer reflected several timesIn reply to lieing about refunding a credit card payment My company uses a credit card charging company that is called “Square”This company does all of its business over the internetIt is very hard to get an actual customer service representative on the phoneSeveral attempts were made to get someone on the phone to request help on how to refund a partial deposit and no luck was hadThis is why I resorted to a check refund3.) As for having the crane booked for several other jobs that day that would be impossible The crane was booked solely for [redacted] job as a priority and was planned to be used there for most of the dayThe one other job that it was planned to be used on was a small filler job nearby his addressThanks for your time,Timothy Peare

The customer called in an emergency call for a tree that fell on his garage after high windsI responded as soon as he called and drove minutes away in the rain at night in rush hourThe customer signed contract and gave a check deposit that I held and didn't depositSince the call was an emergency we put him in front of weeks worth of scheduled work to help himSince it was last minute my company hired another tree company that was located near the job to help since the tree was highly technical and dangerous and also so there wasn't a chance of us not finishing it in the day we startedWe worked together on the jobThe job was started as early as possible with last minute noticeSince the customer was a referral of a satisfied customer and contractor and that he saw how much we had accomplished already he paid us $in cash before he left for vacation and I gave him his deposit check backThe customer stated that we could leave the large tree logs next to the the road and the township would take themHe called back when the township wouldn't take them and insisted we immediately return and remove the large logs and refused to pay for pickup or disposal fees of blue spruce logsHe was given a quote for the removal and hasn't paid for it and never did

I received a call from *** *** *** on September midmorningHe explained me he had a hazardous tree in his backyard and that it was dangerousAfter hearing that I change my plans and was looking at his tree meeting with him that same day with in an hour ***
*** *** was a previous customer of my business Pearetree landscape and designHim just like all customers in the past have been nothing but pleased with our workAfter seeing the tree explain to him that it deafly was hazardous and should be done soon as possibleAfter viewing the tree only from the ground I thought that it could be removed safely with the bucket truck I explained to *** thoroughly how we would do it even though the Neath the tree there was a zero drop zoneUnderneath the tree included a hot tub, shrubs, a gizeebo and multiple fences and many other obstacles that couldn’t be moved I always try to put hazardous trees first with customers so I told him that I would try to be there within the next to weeks since we already rescheduled out to months He told me he would get back to meOn a Tobar fourth I receive the voicemail and *** *** *** gave me the verbal agreement that he wanted to go through with the jobI met him at his home October and took a percent deposit to get them on the scheduleOver the next few weeks we were very unlucky with the weather that made the job impossible to completeMany days of heavy wind and many days of continuous rainAs there’s one on *** *** *** got more and more impatient and I had to explain to him that I have to prioritize emergencies and when windstorms take down trees on peoples cars, their homes and across driveways for example that I have to clean up those trees first and put standing trees next He seem to understand but as time went on still was very impatient I also explained to him that my company was not large and it consisted of four workers including myself and we could only be so many places at onceOnce we finally got a break from the weather we agreed on November On November my crew arrived at his home around AM And started our procedure preparing to take the tree down One secured in the tree my Climber climbed the tree and realized that once he was up in it that removing the tree with a bucket truck would be unsafe and or could cause possible damage to surrounding Spinny the tree My foreman and explain the situation to the customer and again he seem frustrated but understood That day November I called the Crane man corporative to schedule a crane to remove the tree as soon as possibleHis soonest available date was December Over the next week the customer and I played phone tag you two are both busy schedulesI explained to him multiple times the process on how we would use the crane to take the tree down safely and efficiently and would be no up charge on his bill at all On November at 12:PM *** *** *** left me a voicemail confirming and excepting the removal of the tree being done with the crane and again wanted me to call him with more Logistics After speaking to him I called the *** *** *** and put a nonrefundable deposit of $to hold the crane for the schedule tree removal date of December On December I receive multiple text messages demanding that I call *** *** *** as soon as possibleWhen I get a break from work that I called him and he told me that he changed his mind about the job and he didn’t want to do it any longer I explained to him that the crane has been booked and he seemed careless about it*** *** *** did not give me any reasons why he change his mind besides that he was frustrated how long this is taking*** *** contacted me multiple times about getting his deposit refundedSince he paid with a credit card which I don’t except very often giving him a refund wasn’t as easy as cutting him a checkAfter trying to contact the credit card company and having no luck I told him that I would refund him with a check of mine from my businessBefore meeting on December to issue the customer his refund I offered him another chance to remove the tree since the crane was booked for that day already He demanded nothing but his full deposit back Customer met me at the *** *** where I try to explain to him the situation that you put me in by changing his mind after I’ve already given a deposit for the craneNot only was he very short with me and wouldn’t even sit down to try to work it out, when I gave him the check for his refund which was his deposit amount minus the deposit I put on the crane he refusedHe threatened me multiple times with different ways he would go about getting the money back like through his credit card company and reporting me to the Revdex.comHe also texted me multiple times the same thing In the attachment I included the proposal that I wrote him for the tree removal with all the details and datesI also attached the receipt for the crane and a picture of the check I offered him I have all of the voicemails and text messages save for any ones viewing for detailsAnd my contract on the bottom it reads “All agreements contingent upon strikes accidents or delays beyond our control.” Delays like weather and emergency jobs play a key factor in scheduling in this industryThis is the first time that I’ve ever done this so if there’s any other information that I can offer in or include to make the situation easier to understand please let me know

emergency we put him in front of 2 weeks worth of scheduled work to help him. Since it was last minute my company hired another tree company that was located near the job to help since the tree was highly technical and dangerous and also so there wasn't a chance of us not finishing it in the day we started. We worked together on the job. The job was started as early as possible with last minute notice. Since the customer was a referral of a satisfied customer and contractor and that he saw how much we had accomplished already he paid us $2210 in cash before he left for vacation and I gave him his deposit check back. The customer stated that we could leave the large tree logs next to the the road and the township would take them. He called back when the township wouldn't take them and insisted we immediately return and remove the large logs and refused to pay for pickup or disposal fees of blue spruce logs. He was given a quote for the removal and hasn't paid for it and never did.

I am rejecting this response because:1. Mr. Peare did not tell me about a non-refundable deposit for the crane nor was a crane ever mentioned when the job was contracted.  As a tree service professional, he should have known what was required when providing an estimate for the work. 2. Mr. Peare promised on several occasions to refund my deposit but made not mention of deducting his deposit for the crane for which I have several texts.  He lied about trying to refund my credit card and gave me a story about how he was having a hard time doing that.3. Mr. Peare informed me that he was using the crane for several other jobs because he booked it use for that day.
