Dear Revdex.comWe are sorry that [redacted] is experiencing issues with his HVAC system.HVAC systems in the valley of the sun are subjected to its harsh, and many times extreme temperature conditions.Mr [redacted] new home warranty started on the Close of Escrow day of 5-27- His HVAC system came with a very good year full parts and labor warranty along with another three years of a major parts warranty where the part would be covered but the labor would not Most builders in the valley only offer a one year warranty on their systems Until June of this year we had not heard from [redacted] since September of when he was having an issue with a vanity faucet According to our contracts and AZ state law if a home owner has an issue with a home and they think it is something that is the builder’s fault they need to notify the builder to look into the situation (Please refer to A.R.S§ 12-1363(A)and A.R.S§ 12-1363(B)) This was not the case here [redacted] called his own trade who performed the work and then sent us the bill We had our Warranty Representative [redacted] reach out to the [redacted] who said we needed to pay for a valve that was leaking and that hiscontractor had already replaced [redacted] said he was told by his trade that the valve should have lasted ten years and wanted us to pay for it We looked at the receipts and found that the new part he purchased was only warrantied by his contractor for one year, not the years the trade told him they should last [redacted] also found out that [redacted] had previously hired other HVAC trades to service and work on his HVAC Servicing units many times includes using the valve in question which could have been damaged from others Furthermore we reviewed our warranty records of the home and did not find evidence of prior issues with the units not cooling properly from 5-until 6-2015.It was for these reasons that Maracay Homes declined the request to pay for the workThank You [redacted] ***Maracay HomesConstruction & Warranty Area Manager
Maracay still stands behind our decision The part that you replaced is a manufactured part that held Freon for many years You chose to have it replaced which is part of your home ownership duties The part that you claim we did a poor job installing only came with a one year warranty from the trade you just had replace it I don't feel it is fair to hold us to a different standardRegrettably our harsh Arizona summers take their toll on AC units and things wear out Sorry [redacted] ***Maracay Homes
The AC had its' first repair due to Freon Leakage in July We had AC out on Friday evening and wait for Maracay's response until next Monday morningOur whole family had to suffer extreme high temperature in AZ summer for couple of days to get it fixedPlease see the attached email communication between Maracay and us for the AC outage recordUpon this repair, the AC professional came in to fix the problem commented that the leakage is caused by the bad installation and it will probably leak again in the near futureTherefore we requested an extended warranty from Maracay but it was deniedThis is also recorded in the attached email. As in their response they denied any reported AC repair since the purchase of this home, it already shown how poorly their quality system is managed and how irresponsibly they treat their customers. Since we had a bad experience from maracay customer service, at the time when we had 2nd AC issue in summer, we went ahead to order the repair by ourselves, instead of calling Maracay and wait for weeks to get it fixedAll the AC professionals came in to fix the AC had comments on the poorly installed AC, and due to this reason, the AC could be out anytime in the future
Dear Revdex.comWe are sorry that [redacted] is experiencing issues with his HVAC system.HVAC systems in the valley of the sun are subjected to its harsh, and many times extreme temperature conditions.Mr. [redacted] new home warranty started on the Close of Escrow day of 5-27-2011. very good 2 year full parts and labor warranty along with another three years of a major parts warranty where the part would be covered but the labor would not. Most builders in the valley only offer a one year warranty on their systems. Until June of this year we had not heard from [redacted] since September of 2013 when he was having an issue with a vanity faucet. According to our contracts and AZ state law if a home owner has an issue with a home and they think it is something that is the builder’s fault they need to notify the builder to look into the situation. (Please refer to A.R.S. § 12-1363(A). and A.R.S. § 12-1363(B)) This was not the case here. [redacted] called his own trade who performed the work and then sent us the bill. We had our Warranty Representative [redacted] reach out to the [redacted] who said we needed to pay for a valve that was leaking and that hiscontractor had already replaced. [redacted] said he was told by his trade that the valve should have lasted ten years and wanted us to pay for it. We looked at the receipts and found that the new part he purchased was only warrantied by his contractor for one year, not the 10 years the trade told him they should last. [redacted] also found out that [redacted] had previously hired other HVAC trades to service and work on his HVAC. Servicing units many times includes using the valve in question which could have been damaged from others. Furthermore we reviewed our warranty records of the home and did not find evidence of prior issues with the units not cooling properly from 5-2011 until 6-2015.It was for these reasons that Maracay Homes declined the request to pay for the work. Thank You[redacted]Maracay HomesConstruction & Warranty Area Manager
