Because the contract was for limited repairs to an existing house work that was not in the original limited contract became necessary at the partition between the unit which was to be renovated and the unit which was not to be renovated. ...

Unforeseen conditions required extra work which was not in the original contract or scope of work. To keep the clients budget we agreed to perform most of this extra work at no charge but our ability to perform the work was limited by the cost and our schedule. This large and complex project has been completed except for the damaged screen door, and finish items in the adjacent unit which we were not contracted to perform but have since agreed to perform at no cost to the client.
We have agreed to get all the work on the clients punchlist completed by August 14th except for the installation of the hot water solar system which we are currently getting subcontractor bids on.
Initial Consumer Rebuttal /* (3000, 7, 2014/08/07) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept the response from [redacted]. His plans from the beginning clearly showed that he was going to move a wall back about two feet, taking space from a closet in the ohana unit that we were not planning to renovate. I had issue with the loss of space on that side but he was adamant that in order for his floorplan to work then he needed that space. It shows on the floorplan, drawn by him, so why is he insinuating that it was not in the original scope of work? He was demolishing my closet and said not to worry because it will be fixed. It is misleading for him to say that he agreed to perform this "extra work" at no cost to us. He destroyed a wall and closet due to his drawn plans, he needs to repair it. The cost and his schedule was not compromised by me. He was dishonest about how he was spending my money. He hounded us weekly for money, before the work was completed. Even his subcontractors were harassing me for money to pay for work that I already paid to [redacted]. He would start a section to show us he was working on it and tell us that in order to keep things rolling we needed to pay at that time. As soon as payment was made workers were scarce. Our house was abandoned for months, only half covered with siding. We soon realized that our money was being used to finish his previous jobs. He then had the adacity to insist I pay out of pocket for materials and finishes. He has not completed everything on our list. He may have his own punchlist, not ours. I want my patio doors functional, my solar water heater (which I paid for over a year ago) to be installed, threshhold in the master bathroom installed, the closet repaired. He also has unprofessional tactics of avoiding phone calls. He either does not answer calls or when he does he says he will call right back and he does not. He says he finished the work but he did not. He came to measure the closet-again. Said he was buying the materials and a worker will come by if not Friday, then on Monday. No one has come by since. My punchlist includes the completion of the project which includes the paid for solar water heater. If he cannot do this by 8/14, I expect a full refund so I can hire someone else. He says he is getting bids on it but he told us numerous times he already has the plumber ready to do it he just needs money. He even asked us to pay out of pocket for it and we refused. Thus, we were shut down. He asked for time and we have been overly generous with it.
Final Business Response /* (4000, 13, 2014/08/18) */
The contract was for interior work to be done in one side of the two unit building which was completed. The plan shown on the contract does not have a closet shown in the room being used as a guest bedroom or Ohana bedroom. The approved plans from the City and County of Honolulu DPP clearly show that no work was to be performed in the Ohana unit. It clearly shows a storage area adjacent to and accessed from the car port. We provided this storage area and did it in a way so as to make the Ohana bedroom more liveable. No drawing or budget for the closet in the Ohana area was in the contract.
Because of field conditions we encountered during the alteration of the main unit the partition wall between the units had to be reframed. We did frame a closet area at the owner's request however the door and shelving for this closet was not in the contract. We have installed lights, switches, closet shelves, and a closet door in this area which we did not have a budget or a contract for.
We did this work which has a value of a few thousand dollars at no charge to the owner. We do however feel that the finishes such as light fixtures, doors, shelving etc. be charged to the finish Allowances of the contract as were all other finishes we installed in the project.
Now that all work other than the Solar Hot Water System to be installed independently by a licensed Solar Contractor we are requesting that the Owner agree to the completion of carpentry, finishes, and paining and agree to the final amount to be charged to their finish allowance before the Solar Hot Water System is installed.
The Allowances as a part of the contract are not to be exceeded without a written change order and this is what we are requesting in order to finalize the project.
Once we have a written statement from the owner that all the carpentry and finishes are complete and we have a full agreed accounting of the allowances we will be in a position to install the Hot Water Solar System.

This was a major addition above an existing single wall home which entailed removing the roof of the structure.  We warned the owner that living in the structure during renovations would be difficult, dusty, and effectively camping out as most of the electrical and plumbing systems would be...

disconnected during constructions but they insisted because of economic hardship.  There was a four bedroom two bathroom area which was not to be renovated or touched at all under our contract.  We were not told by the owner that this section of the house had been rewired by a non-licensed electricians and was full of electrical deficiencies and unsafe conditions.  Once work started we discovered the unsafe and sub-standard wiring and offered to remove and replace it however the owner would not agree to the cost of this work and did not want it included in the contract scope of work.
During the construction as the roof was removed some water and moisture got into the sub-standard wiring and caused the entire area that was not a part of our contract to fail. If this wiring had been correctly installed they would not have had issues with it.  In the end we were forced to re-wire this section of the house at no cost even though it was not in the original scope of work, however having ten people living in the structure during construction limited our ability to complete the work at one time and caused the owner's to be inconvenienced by limited and partial electrical service during construction.
Then the owner's decided to do renovations on the two downstairs bathrooms in the area not in our contract without a contractor, permits, or a licensed electrician.  this further complicated our ability to effectively and completely replace the defective wiring.
To date all wiring has passed the City and County of Honolulu electrical inspections. At this time the renovations the homeowner is doing to the two bathrooms which were not in our scope of work or contracted by us are still ongoing and there are uncompleted electrical circuits.  once this work is complete and inspected by the City and County of Honolulu electrical inspectors, if there are any unresolved electrical issues we will be happy to trouble shoot these issues.
The project was completed and is a very nice, strong, good looking house which has a beautiful interior and the owner's are enjoying it. The owner's end cost for the size and scope of the project was very competitive.  If the owner's had been able to move out, had been more forthcoming with the work done to the house by them, and had been agreeable to the change to the scope of work to the electrical system when we discovered the problems i'm sure they would have had a more positive experience with the rebuilding of their fifty five year old home which now is in brand new condition.
