To Whom It May Concern:
I just received the Revdex.com complaint filed by Mrs. Jackson. It took a while to come to my attention, as the address was incorrect. To be clear Pacific Martial Arts is an independent contractor with the...
Sierra sports clubs for the purpose of providing martial arts instruction. I am the owner of Pacific Martial Arts but have no ownership interest in Sierra Sport and Racquet or Sierra Athletic Club. Clients sign up with Sierra Athletic Club to take my classes and as such I do not nor does my company hold any student contracts all contracts for services are between the customer and Sierra. Since this is a dispute over a contract with Sierra Athletic Club neither my company nor myself should be named in the complaint.
I am certainly sorry that Mrs. [redacted] has had a bad experience. I never want any student or parent of a student to have a bad experience. I liked having her son in my classes and when she told me that he was having trouble in school I offered to help. I am a CA credentialed teacher and have a BA in Psychology with a M.Ed. in education so I am well equipped to help students who are struggling in school. Mrs. [redacted] did not seem interested in that but wanted to cancel her account.
I told her that she should contact Hayley Baker the GM of Sierra Athletic Club and fill out a cancelation form. Sierra Athletics Club's cancelation policy is clearly stated in their contract, which is 30 days written notice with all fees paid through that period and $100 cancelation fee.
I have suggested 3 remedies' to Sierra Athletic Club but these are only suggestions as I am not a party in this contract. It is up to Mrs. [redacted] and Sierra Athletic Club to agree.
1. Pay the contract cancelation fee and any outstanding dues
2. Pay the difference between the month-to-month registration fee and dues and the registration and dues already paid.
3. Finish out the contract.
I would be happy to hear any other resolution ideas and make those suggestions to Sierra Athletic Club but this is only my suggestion and both parties must agree to the terms.
I believe this is resolvable and don't believe that anyone was trying to be deceptive or charge more than should be. In fact a military discount was extended to Mrs. [redacted]'s son when he is not in the military and should not have received that discount in the first place. This tells me that the staff at Sierra Athletic Club was trying to go above and beyond to be helpful. I believe everyone involved wanted the best for her son but there has clearly been some miscommunications and misunderstandings.
I have attached a copy of the prices charged for children's classes. Mrs. [redacted] was given a deal at $65 per month, which is lower than the contract price and significantly lowers than the month-to-month price.
I am also including a copy of the contract signed by Mrs. [redacted] with Sierra Athletic Club.
To date the total amount paid by Mrs. [redacted] is $25 for a registration fee and $25 for a prorated month.
I would love to resolve this so that everyone wins. Please let me know if there is any more that I can do.
Sincerely,
[redacted]
