North American Title Company ("NATC") is in receipt if your July, letter advising of the above complaint filed by [redacted] *** [redacted] complains of improper handling of documentation in connection with his June 28, sale of the above propertySpecifically, he reports that NATC filed an incorrect form with the California Franchise Tax Board ("FTB") relative to the 1/3% withheld from his process for real estate tax withholding On June 25, Mrand Mrs [redacted] completed the FTB's form 593-E to satisfy their real estate withholding requirement (Copy enclosed.) North American forwarded the form 593-E along with a check in the amount of $5,to the FTB on the ***s' behalves [redacted] contacted NATC on June 4, t advise that he had yet to receive his refund from the FTB for the amount voluntarily withheld and that he had anticipated the return of those funds with his state tax return refund Upon hearing from [redacted] ***, NATC commenced a review of his closing file and contacted the FTBNATC's review concluded that the FTB had received the ***s' funds but that the incorrect form had accompanied those fundsOn June 16, 2014, NATC forwarded the correct form (Form 593) to the FTB along with a compy of its paid check representing the funds previously submitted on behalf of the ***s(Copy enclosed.) NATC is advised that the FTB is processing the correction and that the ***s should receive their refund within six to eight weeks of the June 16thsubmission NATC sincerely apologizes for the inconvenience this has caused teh ***s and understands their frustration relative to the escrow service provided in this instanceFor this reason, NATC will refund the ***s' $escrow feeI will forward NATC's check to the ***s under separate cover

On June 25, 2013 Mr. and Mrs. [redacted] completed the FTB's form 593-E to satisfy their real estate withholding requirement (Copy enclosed.) North American forwarded the form 593-E along with a check in the amount of $5,161.50 to the FTB on the [redacted]s' behalves. [redacted] contacted NATC on June 4, 2014 t advise that he had yet to receive his refund from the FTB for the amount voluntarily withheld and that he had anticipated the return of those funds with his state tax return refund.
 
Upon hearing from [redacted], NATC commenced a review of his closing file and contacted the FTB. NATC's review concluded that the FTB had received the [redacted]s' funds but that the incorrect form had accompanied those funds. On June 16, 2014, NATC forwarded the correct form (Form 593) to the FTB along with a compy of its paid check representing the funds previously submitted on behalf of the [redacted]s. (Copy enclosed.) NATC sincerely apologizes for the inconvenience this has caused teh [redacted]s and understands their frustration relative to the escrow service provided in this instance. For this reason, NATC will refund the [redacted]s' $330 escrow fee. I will forward NATC's check to the [redacted]s under separate cover.

Review: At North American Title in order to close on a property to have clear title they told me this (The title insurance requires Per title: The HOA and Wells Fargo have 1 year from December to claim the tax sale was improperly handled, this is not a right of redemption, they have to claim a defect in the tax sale such as a failure to give proper notice. They can waive that right and if they did we wouldnt have to wait the year.)They could not provide me a waiver of rights form and I try to find one online that would fit on what I need. I had created one and I did send the document to the company. Refuse to look at it which it would take a few minutes but instead they say they will look at it next week. If they can read my emails and resond but they can not take a moment to look at the document so I can have the parties sigh so I can have the title close. I do have health issue. I need to sell the property so I can pay on my debts because they are calling me every day. I can't handle all of this. My credit is in bad shame because of all of thisDesired Settlement: I need the waiver looked at by giving me a go head to let the parties sign the document. So I can get on to selling the property but I need a clear title .

Review: When selling our home last year we used North American Title, in Modesto CA. We put our trust in the company believing that they would take care of us and process our escrow the right way. Then when we received our California Tax return, we were missing the $5,161.50 we were expecting to get from the tax withholding. Stupidly I assumed still that they had done the job correctly and thought that the remaining money would come soon after. When it did not I began to investigate why it had not come. This took several phone calls over a few days and hours of holding and transferring to figure out that the escrow company had sent the WRONG FORM. They were supposed to send the 593 form instead they sent the 593-E form. This money was supposed to be used to fund a project I am working on. I can not begin to explain the inconvenience my family has experienced because this money is STILL in holding from the Escrow Company screwing up and sending the wrong form. $5k may not be a lot for everyone but it was the difference maker for our family to get by while spending all my time and money to finish this project is was working on. The incompetence of this company has created a Huge burden on our family as well as effected our well being and potentially ruined our credit. The worst part is that I found that my partner in this project had the EXACT same issue happen to him as well. Apparently this is not the first time this mistake has happened and the issue was not resolved, even once it was exposed. That negligence has resulted in my inconvenience.Desired Settlement: I paid for a service to be completed properly and it was not. I would like compensation for the services that were improperly conducted as well as compensation for the inconvenience we have suffered because of the mistake made.
