I am rejecting this response because:Linds still refuses to accept responsibility for initiating and completing work without a permit as required by the city. They earlier offered to have the Revdex.com arbitrate. Without some concession on their part at all, I would like to pursue arbitration.

I am rejecting this response because:I have owned and managed properties for 50 years. I have also had 2 other heating systems replaced in the last 2 years. Never have I seen a case where removal of a replaced heating system was not done or subject to additional charge. As to additional work done, Linds had the opportunity to examine the system before their bid and was aware that there was additional ductwork needed and to be included in their work to make things up to code.
I have read where their estimate did not include the permit. At worst I assumed that might relate to the cost of the permit but not the getting one. I believe information required on the permit is primarily known by the contractor as opposed to the consumer. Further, regardless of that, the city does not allow work to start without one and according to their letter to Linds, indicated it was linds responsibility to be sure their was one.
As stated in my complaint, the manufacturer of the furnace([redacted]) did require additional documentation sent to them to facilitate a full warranty and ultimatly corrected that with Linds and had them provide the model and serial #.
My view is that I have never seen a vendor refuse to take responsibility for their actions in spite of letters from the city which was in effect a cease and desist order

Lind’s Plumbing & Heating did contract with this customer to replace a furnace and completed the work that was specified in that contract. The contract did not include removal of the old furnace and specifically excluded permits....

When the customer contacted us about his desire to have the furnace removed from site as well, we put in the necessary time and material to do so, even though it was not included in the contract. When we were notified the customer did not pull a permit, we did so and paid for that as well. Additional work was also done at this residence free of charge that was not included in the contract because Lind’s takes pride in their work and didn’t feel it was right to leave the job with damaged and improper venting. We informed him that we, Lind’s, do not register the product’s warranty through the manufacturer because we do not own it. Homeowners have the choice to do that if they wish. When we purchase the unit, the warranty is automatically valid through our vendor so if the customer has any issues, they can contact us and we go through our vendor to get warrantied parts. This info was conveyed to him and we told him he could contact us with any issues. We informed him the model and serial numbers were on the unit and any manuals or paperwork that came with it were either attached to the furnace or left on site, depending on how it was shipped.

In regards to removing the old furnace, it required us to re-plumb a water line to get it out of the crawlspace. It is not uncommon for homeowners to leave old units in crawlspaces if they are not easily removable. As I stated before, we did remove it and he was not charged.
In regards to the permit, the proposal clearly stated they were excluded. It did not state that the fee was excluded. When notified it was not pulled, we did so and paid for it.
In regards to the warranty, it is the homeowner’s choice to register it if they wish. As I stated before, the warranty is automatically activated through our vendor. If a homeowner wishes to register it, the information they need (model and serial numbers) can be found on the unit that is in their residence. When we spoke to [redacted] that is all they were looking for and it could’ve been provided by the homeowner.
Lind’s complied with what the city requested and pulled a permit.
