Unfortunately for the customer, he is unaware of the direction of the Board (not just one individual or management) since he resigned his position as Board President of the Association. Management has been involved with the City in a complicated process before and after the installation of the "traffic cushions" as evidenced by the City (Fire Chief) tolling the time on the dates contained within his letter referenced by the customer. The customer is perhaps unaware of this communication between the City and the Board. The City and HOA continue to be working on this matter.=
Review: NCM counseled and collaborated with the [redacted] to intall, without proper planning and permitting, traffic calming devices ("speed bumps") within the property. This was an egregious violation of city ordinances which require a proper plan be submitted before consideration of the granting of a permit - should the plan be accepted. The City of Folsom has issued a "Notice of Violation" for this wanton disregard for ordinances (the law) and has mandated the removal of these within 30 days. Failure to do so is a misdemeanor, accompanied by a fine schedule that could eventually result in removal by the city as a "hazard" at the cost of the HOA. This was an unconscionable act given that the agent of NCM responsible for advising Rivage is a former planning director for the City of Folsom and the Board President is an asphalt contractor. Both are intimately familiar with the importance of the permitting process. The residents are now caused not only underwrite installation, but removal as well within two months, will have no traffic mitigation structure and will have been caused to use associations funds to no end. This is not merely ineptitude, but an act of unfounded arrogance and malfeasance and the general fund/residents cannot be compelled to sponsor such an offensive act.Desired Settlement: NCM, or its agents, and the five members of the Rivage HOA must, in equal proportion, reimburse the general fund of the association for any and all costs related to the installation and removal of the traffic calming devices as well as any fines or penalties associated such.The residents/homeowners cannot be held accountable for the consequences of a deliberate and knowing illegal act by leadership and a service provider.
