In June of 2014 we contracted to have our lawn redone. the the lawn was to be seeded and fertilized, plants and shrubs to be planted, and mulch beds prepared. While the removal of the existing shrubs was good and prompt, every subsequent encounter has been lackluster and the quality of the work lacking. when two wilted hydrangeas were placed into the ground, we were told to give them time to acclimate to the soil. When they didn't, it took nearly a month to get him out to fix the problem. This year, once the snow melted, we noted thatNearly every shrub placed had died, 8 in total. when we called him, on [redacted] we were accused to not watering properly, when 7 other plants did come back. since that time we have attempted to contact the owner on several occasions. Our contract guarantees all Plant materials for up to a year. one week, his trucks weren't running, the next week he promised he would come and didn't. The following week, we were being accused of not maintaining our yard properly and because of that, he essentially considered the job to be not "a big deal." this past week we were promised he would have the job done by Friday. At that point we told him we'd easy just take the seed and do it ourselves, to which he responded that we wouldHave the seed by the weekend. after an entire weekend of no return phone calls and no seed, we are left with no choice but to pursue other options. He's taken our money and taken advantage of the situation. It has been a month since the initial phone call, and he has since removed dead shrubs and added mulch. No new plants have been planted, and noReseeding has been done in spite of several attempts of correspondence and several promises that the work would be done.Product_Or_Service: Lawn careDesired SettlementWe would like enough seed to reseed our lawn or a partial refund in the amount of the seed and the 8 dead shrubs that were never replaced. Business Response The Client contracted me to clean up her property that had been neglected for years. We cut down and removed all the overgrowth. We shaped shrub beds in the front and on the sides of the property. We planted shrubs and installed a lawn in the front and on the side.I verbally gave her explicit instruction to water shrubs and newly seeded lawn and to fertilize every 5 weeks. After a year, shrubs and lawn had died. I replaced with new shrubs and reseeded the lawn. Before the year was up, they had died again!I told her she wasn't watering, and of course she said that she was. I asked her when the last time she fertilized the lawn and she avoided the question. I pulled out the dead shrubs, edged and re-mulched the beds again.I feel I went above and beyond trying to please her. She took no accountability for the failure of the shrubs or lawn. There is nothing I could have done to please her.In closing, when we had initially completed the work she was amazed at how great it looked. Unfortunately she did not take the proper steps to maintain it.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)we were guaranteed that we would have our materials that we would need to reseed the lawn. The first week we contacted him, he avoided us because his trucks were down, the next week, he was unavailable again. The third week, he had a "mulch situation." He accused us of not maintaining the yard yet did not provide written instructions regarding fertilization. He does not know that we did not water our lawn. We watered our lawn everyday several times a day. To feel as though he is not accountable simply because he presumes what isn't true is absolutely absurd, especially considering that we have a contract that guarantees all plant materials for a year and like I said, there were no written instructions regarding fertilizing. since our complaint filed a month and a half ago, he has remulched and pulled out dead plants. None of the right plants were replaced and no reseeding has taken place, and no seed has been delivered for us to do ourselves, which he promised he would do two weeks ago and never did. Every company I have contacted since this whole situation has stated to me that clients are not responsible for fertilizing, and that the landscapers are. Additionally, like I said, while he accuses us of dodging the question, that's all he is doing. If that was an expectation, that should have been written in instructions for us to do. When I said this, he mocked me and yelled at me that this was "common sense." We are still waiting for enough seed to reseed our lawn (that he promised would be delivered weeks ago), or a [redacted] refund to plant all the plants that were guaranteed to be replaced, and never done so.
