Ms. [redacted] made an offer and Landmark 24 Homes of Georgia, LLC did not accept her offer. Landmark 24 Homes of Georgia, LLC and Ms. [redacted] do not and did not ever have a binding contract. There is no breach of contract as there never was a binding contract.
While her understanding of the earnest money deposit’s purpose and that the builder/ seller does have every right to ask for more earnest money deposit as part of a counter offer, if they so decide, the complaint is now a moot point since there never was a binding contract between Ms. [redacted] and Landmark 24 Homes of Georgia, LLC.
