Kurt*** doing business as Kustom Pools and now *** took $30,000 and refuses to deliver or refund.
Kurt*** doing business as Kustom Pools and now *** took $17,000 in November 2018 for a pool to be delivered in May 2019. In April he required the balance of $13,000 to deliver, which we paid. Promised delivery month after month until September when he said he would never deliver our pool or refund our money.

Desired Outcome

Refund.

The customer can have the choice of having the pool still delivered or exploring other options to satisfy the matter .

Kurt *** promised delivery in May 2019. He demanded the balance due ($13,000) in March of 2020 as his contract clearly states the pool will not be shipped outside of Canada until he has that. We wired the money. In May we heard nothing after repeated attempts to contact. He said he just needed to schedule the delivery but the trucking company was closed on Victoria Day. When we heard nothing we again demanded delivery and he said end of May that he was manufacturing defective pools. Nothing. When we demanded delivery end of May, the said two more weeks. This went on three more times, and of June, end of July, each time he promised delivery and that he was sending customs documents. Finally when we demanded delivery yet again he wrote in September and copied his attorney saying he did not like negative reviews and that it was not his fault that he could not deliver his defective pools, that we were responsible, and the pool was ready for delivery (again). So we gave him a two week window for delivery and we never heard from him again except for him to tell us to take legal action against him, that he would never deliver our pool. So, buyer beware. He has lied consistently since November of 2018 except for the information needed to wire him money.

We ordered and got delivered a pool through this company which is now operating under seventeen pools.
The pool is rusting and is made unsafe as the nuts/bolts around the pool window are installed inside out which have caused injuries to our kids.
The leak in the pool is causing damage to our piles of the deck.
The gas heater is not passed by Manitoba hydro.

We have tried to work with owner Kurt *** and he has just stalled it since weeks.
Even now we don't have any schedule or commitment from them to fix it.

They contract also calls for installation of speakers and tv and nothing is done for that since the delivery.

Refund We want him to either fix the pool by 10 August with filling the water back in the pool or refund our money and take this *** product back.

Looking for our deposit money back for a container pool not received. The total is $25,000 USD
In Oct of 2018 we contacted Kurt for a container pool. We sent him a deposit of $25,000 via wire in 2 payments. At that time I asked him to provide a surety bond. He sent me a letter from an insurance company stating it had been applied for. After many unfulfilled promises and missed deadlines as well as finding out how much he owes others I asked for a refund. He once again has promised on multiple occasions a repayment schedule which I have yet to receive. I also found he has opened up the same company under several other business names

Refund. I would like to get in line with the rest of the folks that he owes a lot of money too.

My husband and I ordered a pool and gave a deposit of $18,000 USD to Kustom Container Builders June of 2018. After three months of waiting for our pool to be built, Kurt the owner of the company, told us our pool was ready for delivery we just needed to send him the second half of the payment. We sent him an additional $10,000 USD and after 3 months our pool was still not delivered nor was it built. In November of 2018 we also hired a structural engineer and an architect to assist with installation and permits. After three months of back and forth between Kurt and our team, Kurt was unable to supply structural calculations, details and drawings stamped by a licensed engineer needed for permitting prior to installation. On February 25th, 2019 our team advised us to obtain legal counsel as well as cancel our order with Kustom Container Builders, as any manufacturer who is unable to provide the purchaser with basic structural drawings does not manufacturer a structurally sound product. On March 6th 2019 we emailed Kurt to inform him that we could not proceed with the purchase of this pool unless he could provide us with blue prints for the pool. We asked him to cancel our order and refund us our money and his response was that his lawyer would contact us. Since then we have heard nothing from Kustom Container Builders.

Refund Full Refund of approximately $28,000 USD

In October, 2018 we engaged Kurt ***, CEO of Kustom Container Builders (AKA ***, ***) to negotiate a contract to have them build a custom container pool for us, and have it delivered to our Ontario Address.

A good faith, 100% refundable, deposit of $10,000 (About 1/3 of the sticker price) was provided to Kustom Container Builders to ensure a May, 2019 Delivery date, which upon delivery would be applied to the agreed final Purchase Price.

The conditions were that the contract, final price (elements could be added on during construction) was satisfactory to us, and that Kustom Container Builders would provide financing for the balance owing. If not, the Deposit would be returned.

Kustom Container Builders was unable to provide financing options, no contract was ever signed, and with time running out on a reasonable delivery window, we asked for our deposit back.

Our concerns with Customer Container Builders grew the following month as a result of what appeared to be a poorly written contract, poor communication, and the inability to get a straight answer as to the status of the financing for the project.

The final straw was a mass email sent from a former employee announcing he had been dismissed, which subsequently lead to a massive string of emails from other customers/suppliers who had deposits owing them, unpaid invoices, or damaged/faulty pools requiring repair. ***
Kurt ***, Kustom Container Builders CEO. was quick to respond to our request and let us know the funds would be returned, but could not provide a timeline. We placed a two week deadline for the return of our deposit, it has now been over two months.

The Kustom Container Pools Website is now down, Kurt *** has started another company called ***, it is his third such venture that I am aware of.

Refund I would like our money back.

We ordered a pool from Kustom Container Builders, which was repeatedly promised by the owner to have been delivered and setup by 9/3/2018. As it is now 11/27/18 and the pool has been promised to be delivered least 3 times where permits have been pulled and crane costs totaling an additional $*** that as of this date has not been wired to us so that we can pay back the crane company etc for the fees that have piled up. The response from Kurt the owner has been that we are annoying him with our concerns, but he has been given $*** USD for a pool that is now over 2 months late for delivery. As a consumer we have lost all faith that their pool will even function correctly if/when it arrives or who will support the pool if there are any issues.

In response to the customers complaint, yes we were two months late on delivery due to a influx of work. With regards to the customer wanting a refund on the pool there is no refunds on deposits and unfortunately there is no refunds on the pool. On Nov Tuesday Nov 26 2018 the customer has had contact with our transport carrier and had notified them that the pool is in transit. The carrier had some mechanical issues while travelling to California. Once the pool leaves our shop at Kustom Container Pools we are no longer liable or responsible for the pool once it leaves our possession. As of today Nov 28 2018, the pool will be arriving in a day or so. We have gone to great lengths to build this wonderful pool for the customer and we know that they will truly love it.

The customer was asking for a compensation of $*** and has asked us to use an app called ***, unfortunately *** cannot be used from Canada as the end user requires a US bank account and debit card and Kustom Container Pools does not have that. We have offered to send the deposit via traditional banking but we do not have all of the correct information to do so.

In closing the pool has been built and is in transit to the customer at great expense. We will not be offering any refunds at this time.

The owner of the business has promised to return our US$*** deposit for over a month, and has confirmed by email numerous times that they have already sent the wire returning the deposit. However, they have not but provided any proof of wire despite repeated requests, nor have we received our deposit back.

We now have the refund ready for Ms. and we need her banking information for the second time as the first time the wire transfer was unable to complete. We are very happy to refunds Ms.s refund due to her financial circumstances.

We have been in contact with the customer about her concerns and have addressed the issue with the customer. We will be issuing a refund to the customer in the allotted time that we have to do so.

After signing 1st contract and virtually no progress on project, we agreed to nullify the 1st contract and agreed to new terms, which included a Loss of Income clause. This second contract has also been breached with very little progress on the build and only small payment on Loss of income. Also on 1st contract we paid a subcontractor directly to avoid them placing a lien on our property due to Kustom Containers not paying the contractor, this is just a small example of what has transpired over the past two plus years, we are very/extremely disappointed with this company.

There really is no tangible evidence to date on the project is actually being done, besides a few emails and calls, but no photos of Containers supposedly being prepared.
This complaint will remain in force until Build is well underway ON SITE and Loss of Income payments are made as agreed!

Kustom Container Pools has failed to provide rails for the stairs as well as a ladder for entry into the pool.

Kustom Container Pools has failed to provide the following:

1) rails for the stairs leading to top of the pool

2) a ladder for entry into the pool

Our family had to have a ladder manufactured to fit the pool so it would be safe and secure. This cost $620 and Kurt had agreed to reimburse us for this. That was 2 months ago and after countless excuses, unreturned calls and e-mails we still don't have our money.

3) The inside of the pool is rusting in certain spots due being improperly coated. There is a plan in place to resolve this, but based on everything else I have zero faith in it happening.

Desired Outcome

Kustom Containers needs to do the following 1) send the agreed upon reimbursement 2) make sure the extra coating is sent to repair the inside of the pool. 3) provide rails for the stairs leading up to the pool as promised

We are working with the customer on the issue still outstanding and hope to resolve this matter in the next 30 days.

When it comes down to international payments this can be a black n white situation. This is why we provided a customer a refund with a certified bank cheque for the ladder reimbursement

This business has promised to make good on our original contract as well as follow up on reimbursements for expenses caused by their mistakes. They were to wire the reimbursement to our account "with in the week" and provide us with the promised snap on custom pool cover as well as the stainless steel steps that go with the pool specifically.

Please note, we do have volumes of written documents too numerous to forward as attachments.

Other (requires explanation) Reimbursement of $1398.85 US dollars wired into the provided bank account (they already have the information) the soft snap on pool cover that is made for this pool specifically that he says was "backordered" and the stainless steel steps for the pool that were promised and custom made for our pool as per the original drawing (he also states is backordered) and contract be shipped to us.

We at Kustom Container Builders have supplied and built a 20 foot shipping container pool to our customer. Our customer has requested that we pay for her craning services which we have never done for any other customer.

In our " contract" it does not state that we are responsible for craning services. It is noted on our website that craning services are the customers responsibility.

Since we have shipped this pool to the customer once and then back to us and then back to the customer, which was a total of approx $15,000 this is a huge burden on us financially.

We have satisfied the build for the customer as per her request. At this time, we will not be paying the full amount of the craning services.

After realizing all the expenses that we carried to adjust the modifications for the customer, this is simply another expense that a small business cannot take on.

We do apologize for any inconviences, that this has caused but for us to take on a craning costs that we have never supplied to any other customer, we would find that this would be unfair.

If the customer would like to meet halfway on this cost, we would consider that option.

This is the same thing he has said for months, different excuses each time. The money has still not been wired to my account as of now. I am sending all written documentation and conversations by mail, as there are too many to attach. I will try to fax them first to Revdex.com.

My explaination to Diane *** is that we are going to complete the transaction for her refund shortly, We are in the process of shipping her ladder out to the customer to satisfy the contract.

We have worked very hard for this particular customer and have gone to great lengths to make sure she is satisfied.

The pool that she ordered did not have the ladder that was requested as the ladder wasnt in stock when the pool was sent. We had put in a plastic ladder instead so that the customer could still use the pool. We are going to ship the steel ladder to the customer and she will have to install it.
The pool needed the benches to be moved around inside of the pool, Instead of sending someone from Kustom Container Builders out to Moses Lake, WA, we in return shipped the pool back to Winnipeg at our costs to make the appropriate changes for the customer. We then shipped the pool back to the customer and paid all freight and handling charges.

We have done our best to satisfy the customer and I hope that they are satisfied with what we have done for them

the business made all kinds of promises the same as always, but have not followed through again. They have not reimbursed us the moneys owed, or even ordered let alone sent the stainless steel ladder we paid for, or the snap on custom cover for the pool. They have not done anything they said they would do. Please advise my next step.
