In 2014, Koberlein pumped more than 3,residential septic tanksAlthough it does not happen frequently, the Company's initial reaction is to take responsibility for the repairsThat was our initial response when contacted by *** *** about her driveway.Further investigation on site by a Koberlein manager revealed several important mitigating facts that prompted Koberlein to reconsider its initial position.The extent and characteristichen property damage occurs during our service at a customer's property, ts of the cracking itself was uniqueVoids underneath the blacktop in areas immediately adjacent to the cracked blacktop demonstrated that subsidence of the driveway base had occurredWithout a proper base, the blacktop was predisposed to significant cracking when a truck of substantial weight, like a partially loaded septic truck, was driven upon itFurther investigation confirmed that drainage ditches have been installed on both sides of the sloped driveway, presumably to channel surface water alongside the driveway and down the sloped lot to the bottom of the driveway and streetCombined with the age and thinness of the blacktop (and perhaps the significant freeze/thaw cycle of this past winter), the settling, washing or subsidence of the driveway base itself was the primary cause the cracking, not Koberlein's truckIt is Koberlein's position that the Company's employee exercised due care and acted reasonably when he entered the propertyThere is no way he could have or should have anticipated the latent, weakened condition of the driveway and its missing base material, when a reasonable standard of due care is applied to these specific factsKoberlein's employee's exercise of due care is supported by Koberlein's significant experience in pumping septic tanks; a lengthy history of experience in which the Company has never caused damage of this nature and to this extent to any driveway, everDespite negative pressure placed upon the Company in social media based upon factual inaccuracies, the homeowner's threat of a lawsuit, and the homeowner's attempt to have the Company banned from providing septic services in the Homeowners Association in which the property is located, Koberlein refunded the $paid by the homeowner's father for the services rendered, not as an admission of responsibility, but in an effort to lessen the financial loss incurred by the homeowner as a result of her defective driveway.Very Truly Yours,
