September 25, 2017Dear [redacted] ***:I am the Vice President of Operations for The Klein Company, Respondent in the above matterThis letter shall constitute Klein’s response to the Complaint filed by [redacted] under the above claim number.On June 17, 2017, [redacted] provided notice of his intent to vacate his apartment, [redacted] ***, on August 31, 2017, the end of his lease.On August 8, 2017, [redacted] expressed interest in relocating to another apartment, ***, within the Mill Grove Apartment communityHowever, this specific apartment was leased by another applicant before [redacted] submitted his application and completed the required paperwork.Our Property Manager, Liz C***, was in frequent communication with [redacted] on August 8, 2017, via email and telephone throughout the morning of August 8, MsC [redacted] explained to [redacted] what was required to reserve the apartment and notified [redacted] that there was another client interested in the same apartment.When apartment [redacted] was rented by another client, MsC [redacted] emailed [redacted] to let him know that [redacted] was no longer availableApartment [redacted] is known as the GrouseIn our community of apartment homes, there are only apartments of the Grouse typeAt the time that [redacted] was inquiring about transferring, we had two Grouse type apartments available for rent: [redacted] and ***.We use a revenue management software system, [redacted] ***, to price our apartmentsPricing is dynamic and can change dailyAll available apartments are shown online via our websiteThis includes information about pricing and availabilityEach apartment home is individually priced based upon its unique features and upgradesSince apartment [redacted] had upgraded features it was priced at a higher rate that apartment *** [redacted] did not want to lease apartment ***, the upgraded apartment.It is unfortunate that [redacted] was unable to reserve apartment ***; however, MsC [redacted] was more than helpful in her attempts to aid [redacted] in this processFurther, since rents are posted on our website, the rates for any given apartment are fully transparent at all times.After revoking his intention to vacate the apartment at the end of the lease and renewing the lease for an additional twelve-month term, [redacted] requested carpet replacement and repainting in his apartmentOur community in [redacted] ***’s 5th year of residency will be completed in The carpeting in his apartment was brand new when [redacted] moved in.Although [redacted] had not completed his fifth year of residency, our Service Manager, Ed F [redacted] , inspected the carpeting and painting in [redacted] ***’s apartment on September 5, [redacted] ***’s wife, [redacted] was present during the inspectionDuring the inspection, we found that the carpeting had some minor stainingDuring this inspection, MrF [redacted] also noted safety violations in the apartment: the Smoke alarm had been covered with a rag and the stove had been covered in tin foilMrF [redacted] requested that both the rag and tin foil be removed immediately as they presented a fire hazard to the community.MsC [redacted] spoke with [redacted] on September 15, and offered to shampoo the carpeting now and next year, at the completion of the year of residency, [redacted] would have the choice of either carpet replacement or repainting of the apartment [redacted] demanded that both be done right nowMsC [redacted] reiterated the options above [redacted] hung up on her.Following his discussion with MsC***, [redacted] contacted, her supervisor, Veda W [redacted] September 15, MsW [redacted] spoke with [redacted] and reiterated the options of carpet shampooing and replacement of carpeting or repainting after the completion of his 5th year or residency.On September 18, 2017, [redacted] posted a factually incorrect review on [redacted] ***In the interest of ensuring a positive outcome, MsW [redacted] approved the carpet replacement and repainting of the apartment even though this is outside of our stated policy [redacted] was notified on September 19, The repainting is scheduled for October 23, and the carpet replacement is scheduled for October 25, 2017.The facts stated in this response are detailed in the attached Exhibits which are as follows:Timeline Exhibit A: Notice of Intent to Vacate Exhibit B: Communication Log Exhibit.C: Email Correspondence Exhibit D: LRO Current Pricing Report dated August 7, Exhibit ELRO Current Pricing Report dated August 8, Exhibit FLRO Current Pricing Report dated August 9, Exhibit G: Revocation of Move out Notice Exhibit H: Work Order Exhibit I: Social Media posting noticeBy reaching an agreement with [redacted] ***, we believe we have met with the Desired Outcome that he indicated in his complaintAccordingly, we request that the Revdex.com close the above complaint as having been settled by agreement of the parties.Sincerely,Donna C.Vice President, Operations
