Review: Purchased promotional voucher $150, sent/received email 3/26/13 to schedule trip, voucher exp 5/11/13. Company never replied after.

promotional voucher through Living Social - Voucher #XXXXXXXXXXXX purchased 5/11/12 (good for one full year). Decided to transfer to friend for their use. 3/26/13 confirmed w/company this was fine. My friend tried to reach company (as requested) via text, cell ph, and email. No response from company after several attempts. Voucher expired on 5/11/13. I wrote to company to inquire about a refund or extension of valid promo time, since they didn't respond. They refused, stating it was not their problem. Capt. [redacted] is the only point of contact I've had or dealt with. He has also acted rudely in his replies of refusal.Desired Settlement: following rude treatment/explanation of options available, and lack of acceptance for any responsibility, I seek out a full refund of my $150 voucher purchase price.

Business' Initial Response

Ms. [redacted] bought a Living Social voucher for a six hour tour of the San Francisco Bay aboard the sailing vessel "Imagine." She had a couple of days over a year to utilize this voucher. She informed me that she was not able to utilize the voucher and would appreciate my allowing her to give it to a friend. I was happy to extend that courtesy. This courtesy was offered about two months before the expiration of the Living Social voucher. The dates that were available to [redacted] friend were not workable for her. July fourth was the desired sail date, that particular date was not available. My wife and I received several threatening and rude phone calls from Ms. [redacted], profane language was used again and again by [redacted]. After terminating the repeat phone calls several times from [redacted] she informed me that she would file a formal complaint with the Revdex.com if she didn't have her demands for a sail on the fourth of July, met. I accepted that consequence. It seemed to be the better of two choices for my business and myself. [redacted] wants a full refund of $150, she paid $149 for the six hour tour. Living Social may have already refunded her, I don't know. My portion of the $149 she paid is $104.30. Living Social kept $45.70 of the entire cost to the consumer. I told [redacted] that her voucher is always worth the $149 she paid for it, it could be used as a deduction from the regular fare of $900. This option would give her and up to five of her guests the opportunity to sail the Bay aboard Imagine indefinitely. I also offered her a $100 option of "extending" her voucher's expiration date until the end of the year. Neither of these options were acceptable to her. I believe I went above and beyond to offer her, or her friend, an affordable way of sailing on the San Francisco Bay aboard my boat. Sailing a boat on the San Francisco Bay is a dangerous pursuit, people lose their lives and their boats far too often. There are rules I require of my guests, hence trust is paramount. [redacted] has not been honest, I feel as though it would be foolish of me to put her aboard "Imagine" for a tour of the Bay. So I won't. As far as the refund goes, there will not be one that comes from Captain [redacted] or Imagine Sailing Tours.

1) "The dates that were available to Cristie's friend were not workable for her" A LIE!

My friend attempted to contact the sailing co.by text messg, cell ph,& email but no response from The Captain. Never even had a chance to discuss available dates.

2) "July fourth was the desired sail date, that particular date was not available" A LIE!

The voucher expired May 2013 so it would make no sense to demand a date past the expiration.

3) "My wife and I received several threatening and rude phone calls from Ms. [redacted], profane language was used again and again by [redacted]. After terminating the repeat phone calls several times from Cristie..." A LIE!

I never spoke over the phone nor used profane language nor ever even knew he had a wife let alone spoke with her...I only emailed my compliant to him, & hold these emails on record for proof.

4) "Cristie wants a full refund of $150, she paid $149" A LIE!

Ive only asked for what I paid. However, would happily accept the company's portion of the $149 ($104.30) since it is only his fault we never got to use my investment.

5) "I also offered her a $100 option of "extending" her voucher's expiration date until the end of the year" A LIE!

This was never discussed nor offered to me.

So, I don't know what more to say. I've told the truth and been called a liar, repeatedly. I've made offers to satisfy this customer that have been well received by other people in the same situation. Unfortunately, anyone who will read this will not know who is telling the truth and who is lying. I'll just sum it up by saying I do not accept the response from consumer.

It's my intention to stand by the decision in my original correspondence with the Revdex.com.
