Prior to entering into the contract, Mr***, was presented numerous options for the replacement including, but not limited to enhancements for drainage, increased energy efficiency, and warranty. Mr*** elected to choose the least expensive option which did not include any enhancements over the previous roof systemHertless Brothers Roofing, Incinstalled a new roof on *** *** *** in September 2012. On September 18, completed the work on *** *** *** Warranties were issued to the contract holder, Mr***. The warranties for the project were a Hertless Brothers Roofing Two (2) Year Contractor’s Warranty, issued September 18, and a Carlisle Ten (10) Year Manufacturer’s Warranty and issued September 26, (both attached)Hertless Brothers Roofing, Inchad a warranty obligation to Mr*** for a period of two (2) years, expiring September 18, 2014. From the time the roof was installed until today, Hertless Brothers was notified two (2) times of reported roof leaks. The first was September 19, and the second was December 29, 2015. On both occasions, Hertless Brothers Roofing, Incresponded and investigated the reported roof leaks. The investigation on September 19, did not reveal any active water intrusion into the building. Hertless Brothers report and invoice to Mr*** (attached, dated September 19, 2014) notes that “…Removed ponding water, Checked seams and flashing, Found nothing wrong with roof, It is possible the water staining is a result of condensation … “ . The report of a roof leak on December 29, was outside of Hertless Brothers Roofing, IncContractor’s WarrantyCarlisle’s Warranty obligation to Mr*** was for a period of ten (10) years, expiring September 26, 2023. The investigation on December 29, found a loose piece of termination bar along the wall. This termination bar was sealed and the repair was covered under Carlisle’s WarrantyRegarding the obligations of the two (2) warranties; Hertless Brothers Roofing, IncTwo (2) Year Contractor’s Warranty has expired (expiration September 18, 2014) and the Carlisle Warranty is no longer in effect. Subsequent to the Terms and Conditions for the Carlisle Warranty, Item states: “This warranty is not assignable by operation of law or otherwise. Application may be made by a new building Owner for reissuance of the warranty during the warranty period. Certain procedures including, but not limited to, an inspection of the Roofing System by a Carlisle Representative and fees will apply to reissuance. Carlisle reserves the right, in its sole discretion, to refuse to reissue this warranty”Upon receiving notice of this claim, Hertless Brothers Roofing, Inccontacted Carlisle to see if the warranty had been transferred to another entity affiliated with you or your business. We were informed; no such transfer has taken placeIf the two (2) warranties were still in effect, neither Hertless Brothers Roofing, Incnor Carlisle has or would have an obligation for interior damage or repairs to *** *** ***Hertless Brothers Roofing, IncTwo (2) Year Warranty states: “This guarantee expressly covers the workmanship of the Thermoplastic Polyolefin Membrane (TPO) …The substrate, roof deck, building structure, and its contents are not included in this warranty.” Additionally, per the Carlisle Warranty, Item states: “Carlisle shall have no liability under any theory of law for any claims, repairs, restoration or other damages including, but not limited to, consequential or incidental damages, ….” Hertless Brothers Roofing, Incis sorry that you are dissatisfied and more so that this is a result of Mr***’s poor choices. We believe we have performed our best within the confines of our obligations and would like to find a way to resolve this for you. Review: Flat roof installed at [redacted], has had standing water and leaks since in was put on I believe in September 2012. I was the mortgage holder and later (11/13/13) had to take ownership.

The roof was recently resealed in late December 2015 by Hertless and tenant in [redacted] complained yet again about leaking water through the roof.

I was told there was water in between ceiling and roof. [redacted] was told this will lead to mold. Owner denies any responsibility for damages.

Also, roof in Pearl's has had ceiling lights shorted out.Desired Settlement: Would like full roof repair and all water from the ceiling and above dried out. Ceilings should be repaired or replaced as necessary.

There should be no standing water on the roof, especially after rain.
