I have reviewed the offer and/or response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Per my lawyers money provided would not be plausible as an contract or agreement that would only apply for goods at an point of sale transactions which means I am entitled to my refundAlso per worker at daycare my application was rejected due to it not being filled out correctly so there is no commitment that would bind this interactionI did reach out to the owner at the business who stated they would give me documents showing I would not get an refund but no conversation where I disconnected on owner I advised I would take legal action is all]

Ms*** came to our facility seeking evening care for her childrenDuring that time she signed a contract for us to provide child care services for her for Tuesdays beginning on June 9thWhen Ms*** came in we worked with her due to her having multiple children and we provided
her with a discounted rate so she would be able to put all her children in careIt is our policy that once we sign a contract we are guaranteeing the parent that slot for the days and times specifiedOnce a contract is signed we staff our workers for that time and we purchase food, materials etcWe communicated with Ms*** as well as all of our new parents ,that whether the child attends or not they are still responsible for the payment for that dayWe also advise the parents that if they need to cancel service it is required for them to give us a weeks noticeThis is in both the contract and our parent handbook which Ms*** and all of our parents receive upon enrollmentMs*** contacted us the day that the children were supposed to start to tell us that she would be in the next week but instead of the children coming we received a call from Ms*** stating that she didn't need the services and she wanted her money backAt that time I advised Ms*** of the policy and told her that we couldn't refund her the money because she didn't give us a proper notice but that we could give her a credit for care in the future or she could use our services on a different day but Ms*** refusedI advised her that I could speak with our Administrator to see what we could work out but she became argumentative and irate stating that she was going to sue usI tried to advise her that I could meet with her but I would need ti give her a call back later that evening to give her date and time so she could read over the contract that she signed but she still was irrate and she hung the phone up in my faceAfter speaking with our Administrator we did come to the conclusion that based on the time she spoke to us it was a week after her 1st day of care was due to start so if she gave us a proper week notice it would give her additional day that she could use for service or get a refundShe would be eligible to get a refund for that one day of service which would amount to $but we never got that far to tell her that because she hung the phone up

Review: Child care service collected 4 payments in advance but due to lack of paper work documents also not accurate application I had to complete again. Younger child had surgery had to stay home service not needed children never attended per director Jerry can not get money back have to give two weeks notice which is not applicable since no service reverend per director . Would like refund of 280.00 for service not usedDesired Settlement: To get funds for funds never Received also application never completed due to not having medical forms for school and missing birth certificate

She would be eligible to get a refund for that one day of service which would amount to $70 but we never got that far to tell her that because she hung the phone up.
