We offer a program aimed towards middle school aged children. Her sons coach brought in a group of young men and had them all sign up for the program. We offer drop in rates of $15 per class or a paid in full option for $75 for the whole program. Mrs. [redacted] gave her sons coach a check for the full...

program totaling in $75. The check was made out to our company for $75 before we received it. We do not under any circumstances accept blank checks. Mrs. [redacted] called after her sons football coach decided she wanted to go a different direction with her students inquiring on a refund. All refunds have to be processed through our accounting department which she was made aware of. After looking into the account it was noted that her son attended 4 group training sessions. Mrs. [redacted] was notified that she would not be receiving a refund due to the fact that we offer a drop in rate and she opted for the paid in full option. Also, her son did attend what would be $60 worth of drop in classes(4 in total). She was told he was welcome to continue in the program. However, she declined to have him come back. She stated she would talk with the coach (Nicole) who brought her child there regarding a refund from her since she was responsible for their training. We did not hear from her from her again after 10/12/17 when she said she would take the matter up with Nicole. Starting again in January she started calling threatening law suits. After that point our staff followed company policy and informed her that all further communication needs to go through our legal team.

Fit Stop offers a Personal Training Service at an additional cost. The Program requires a 90 Day commitment by the client and a 30 day cancellation notice. Sessions expired after 30 days and trainers are subject to change.
After the initial 90...

days the client is no longer locked into a contract and there training services are billed month to month. To terminate training service a client must fill out the required paperwork and give a 30 day notice. The cancellation cannot take place until the client has full filled the required 90 days in training program.
Fit stop staff verbally explains the training service terms and conditions before client agrees to training program. The client is then explained the terms and conditions of training program when signing training agreement. It is also posted on Fit Stop's pricing sheet.
The signed agreement by the client is kept on file. In this case, the client was given a copy of the training agreement, which stated the program was 90 days. The client was made aware that the previous trainer would be leaving and a replacement trainer was provided. The client then filled out the appropriate paperwork to cancel. Due to the clients inconvenience, Fit stop waived the 30 day cancellation notice and cancelled clients training service immediately after final contractual payment was made. This saved the client an additional [redacted] that would have normally been billed. Additionally Fit Stop offered to extend the expiration date of current training sessions, which expire after 30 days, provide 2 free training sessions and 2 free months of gym membership. The compensation has a total value of [redacted] not including the saved [redacted] by waiving the 30 day notice of cancellation. The client was ultimately compensated [redacted] for the inconvenience and given our sincerest apologies for there dissatisfaction.

First off the first line of Fit Stops response in no where in the agreement that I signed. Not one word is mentioned about a 90 day commitment by the client, nor does it say a 30 cancellation notice is required. Once again which I was never made aware of. I do have a copy of my original agreement that I signed I would like to see proof of a training agreement that I signed that shows a 90 day contract which there website and face book page says they do not have any contracts. I was made aware of my trainer leaving on September 24th which was a Saturday that left me with two more training sessions left for the end of the month of September. I called [redacted] the following Monday September 26th to ask her if [redacted] would be at the gym that evening for my traing session and she said she would try to call her and find out. I did not hear back from [redacted] for one week. So I called the gym and spoke to someone at the desk to see if she was coming in that evening for training classes they said no she had no appointment scheduled. I did see [redacted] the following day Tuesday September 27th which was when she gave me the cancellation form for training services and auto pay. Finally I have never received any type of compensation of a value of [redacted] I would like to know and when this was given to me.

[redacted]Document Attached[redacted]
Attached is Fit Stop's rates for our training program as well as the client's training agreement. At the bottom it states that all profile programs require minimum of 3 month service agreement and a 30 day cancellation notice. The client's training agreement states that client agrees to the automatic renewal program on a month-to-month basis after the initial 90 days.
The client did receive compensation of [redacted] as Fit Stop waived the 30 day cancellation notice.
The client also received compensation for two months of membership dues, which is a savings of [redacted]
The client also received an extension for training sessions purchased as well as two additional sessions. A value of [redacted]
The Fit Stop website does state that there are no contracts in reference to our gym memberships.
The client did call. She was explained the cancellation process over the phone as well as in person. The client was told she would receive a call back from the Fit Stop associate once contact with the trainer had been made. The client called back to Fit Stop before the trainer contact had been made. The trainer stated she was out of town and would not be in for the training session. The client was made aware.

This is a lie. My son's coach at the time stated these were trial classes that she arranged with [redacted] to see if the boys wanted to attend. After 2 classes (not 4) she stated it would be $75 to continue. I had a check signed not filled in, then we left for vacation. When we returned the coach stated they weren't going to continue the classes and I could get a refund from Fit stop. I called and spoke again with Tuesday and Clint and finally I was advised by Clint I would be getting the refund. I have proof that was told to me. After several weeks and not receiving anything I called again and was advised Clint was no longer there and there is not refund, because they stated my son took the classes, which we know he did not attend. Per there response, I was never advised I had to deal with their legal department. I called several times requesting for Tuesday call me back to discuss this since I have been working with her and Clint. I have to add that none of the other boys or coach Nicole were charged for any of the classes. So why was my check cashed for the trial classes? I am very disappointed with the way this company has promised my refund and now they are stating things that have never happened. The company has falsified statements I never told them I would be speaking with Nicole to get refund from her. I also asked for proof that my son was signed up with any paperwork. They stated they could not provide me with any of that information and didn't have anything with my signature. Nicole the coach is not his guardian, she just set trial class up with Clint directly. Nothing was signed or documented saying I allowed him to sign up for the courses besides the trial I verbally stated the 2 would be fine. I don't understand why the company is going back on what I was told. I believe the company needs to make things right and refund me my $75 for services that were not provided. Again I have attached the messages from Clint stating I would be getting a refund.
