We would like to again state the following facts.  Additionally, our last rejection was on May 24th and we've just received this counter from LCS/Getty Images on June 17th.  
 
1.  The image was removed back in November or December 2015 from our site.
2.  We didn't hear from LCS/Getty Images on behalf of [redacted] until Monday, April 11, 2016.
3. The E-mail provided to us by LCS/Getty Images for Hannah didn't work nor did the E-mail we found for the [redacted] CEO.
4.  LCS/Getty Images couldn't provide a valid itemized list of why the amount was $550.00.
5. [redacted] didn't profit from having the image on the site.
6. When we finally did hear from [redacted] they told us to contact LCS/Getty Images. Sincerely,[redacted]

The Complainant demands that Getty Images provide proof of copyright, the Complainant appears to confuse copyright registration and copyright ownership.  Copyright exists the moment a work, including a photograph, is created.  Registration is optional and is not a requirement of copyright ownership.  Consequently, copyright registrations are not required of us to pursue infringements on behalf of our contributors. While confidentiality provisions prevent us from providing copies of our agreements with our photographers, Getty Images is the exclusive licensor of the Image, with the responsibility to protect our represented photographer’s intellectual property from unauthorized use.  The image may be viewed on our web site here, with our watermark and our contributor’s name:

www.gettyimages.com.  Customers such as graphic designers, advertising agencies, and publishers license our imagery for a variety of purposes, including but not limited to print advertising, billboards, newspaper and magazine articles, brochures and websites.  Our license information is clearly available from each page of our website, and we do not permit the use of our imagery without a license.Notwithstanding the license requirement, like other digital media companies, Getty Images does fall victim to individuals pirating its intellectual property.  To combat this, Getty Images uses both employees and digital image recognition software to locate entities that have used Getty Images’ imagery without paying a license fee.             We sent the Complainant notifications that we had found use of our imagery on their website; that we had been unable to locate a license for such use; and that the Complainant must either: (i) provide evidence that a license was issued, or (ii) pay a fee for use of the imagery.  We included an internal case reference number and provided proof of use, showing our image, along with a screenshot of the image in use on the Complainant’s website.  We asked the Complainant to let us know if they believed they received our letter in error.  The unauthorized use fee what we would typically charge for a license under these circumstances.Even if the Complainant has removed our imagery from their website, removal alone does not resolve this matter.  Our imagery is protected by copyright.  Getty Images either owns or is the exclusive licensor for the image(s) at issue. Copyright law holds responsible anyone who copies or publicly displays an image without authorization of the copyright holder.   Thus far the Complainant has failed to produce a valid license.  The Complainant’s use of our imagery without a license constitutes copyright infringement, for which we are entitled to seek damages. content owners.  Its principal place of business is at 701 5th Ave. #4200, Seattle, WA 98104.  On behalf of third party copyright owners, LCS uses both employees and digital image recognition software to locate entities that have used its client’s imagery without paying a license fee.   In this case, LCS identified the unauthorized use by the Complainant of content that is represented by Trunk Archive.  LCS was retained by Trunk Archive to assist it with searching for potential unauthorized uses of its images.  LCS had authority from Trunk Archive, who had authorization from the copyright owner, to inquire as to whether this use was authorized and, if it was not, to pursue compensation for the infringing use. LCS sent the Complainant a notice that it had found use of Trunk Archive’s imagery on its website and that Trunk Archive had been unable to locate a license for such use.  LCS included an internal case reference number and provided proof of use, showing Trunk Archive imagery, along with a screenshot of the imagery in use on the Complainant’s website. LCS requested payment from the Complainant for past usage of the imagery at issue.  The unauthorized use fee is what Trunk Archive would typically charge for a license under these circumstances.  We also asked the Complainant to contact us immediately if they believed they received our letter in error.  To date, the Complainant has not removed the imagery in question.  Even if the Complainant had removed Trunk Archive’s imagery from its website, removal alone does not resolve this matter. Trunk Archive’s imagery is protected by copyright.  Copyright law holds responsible anyone who copies or publicly displays an image without authorization of the copyright holder.   Copyright infringement is based on strict liability, meaning that the act itself establishes liability and no intent is required.  The Complainant’s use of this image without a license constitutes copyright infringement, for which Trunk Archive is entitled to seek damages, and it is simply doing so through LCS.    The Complainant allegation that LCS representatives will not speak to her on the phone or explain the legal basis for the LCS’s position is false.  LCS representatives have spoken to the Complainant on the phone twice, and have attempted to explain the legal basis for LCS’s position on both occasions.   In sum, LCS has acted appropriately and in good faith, and it is well within its legal rights to seek damages for unauthorized use of images on behalf of Trunk Archive.  We ask that this matter against License Compliance Services be closed. I contacted them (Simon) by phone on 11/17/16 with a counter offer
They had me send proof of why I am offering a lesser amount of $1000.00
I sent11/17/16 message to Attention: Simon/ Case [redacted] including reasons I cannot pay $3120.00.
I called Simon at Getty Images on 11/21/16 to confirm they received my information. He did receive and turned it over to a manager.
Simon told me they are reviewing my offer and I should hear back with their answer after thanksgiving and probably next week.Sincerely,[redacted]
