Response:This is in response to a contract dispute submitted to the Revdex.com on April 18, by previous members of Fitness Lime Kiln Lane locationSaid members will be referred to as MrsJ and MrJ in the following commentsMrsJ and MrJ are disputing their annual maintenance fee that was charged on April 15, At the time of their enrollment MrsJ and MrJ were made aware and given a copy of the following policies of Fitness 1) They were made aware of Fitness 19’s day notice to cancel policy2) They were made aware their monthly dues would being automatically withdrawn, from their EFT account they provided, starting on February 15, and continue on the 15th of each month thereafter, until member ship is terminated per the Day Notice to cancel policy3) They were made aware of an annual maintenance fee, to be automatically withdrawn, one time a year, starting on April 15, and continuing on April 15th of each year thereafter, until member ship is terminatedOn both her and MrJ’s agreements, MrsJ initialed by each of the fore mentioned polices, stating they understood and agreed to themShe and her husband also signed their respective agreements stating they agreed to Fitness policies and proceduresAt the time of enrollment they were emailed an electronic copy of both agreements to retain for their recordsOn March 23, 2017, MrsJ came in to Fitness to submit their day notification of intent to cancel membershipPer the day notice to cancel policy, a cancellation slip was filled out stating MrsJ and MrJ would have one last automatic withdraw from Fitness on April 15, The cancellation slip also states MrsJ and MrJ would be able to continue to work out at Fitness for an additional days, through May 14, 2017, after final dues were withdrawnMrsJ signed the cancellation slip and the yellow carbon copy was provided to her for their recordsA white copy of the cancellation slip has been retained at Fitness for our recordsOn or around April 18, 2017, MrsJ spoke to Fitness 19’s club coordinator disputing the annual maintenance feeThe coordinator reiterated the policy to the members and emailed a second electronic copy of the agreements to MrsJ and MrJAround that same date they reached out the Revdex.com to file a contract disputeAll maintenance fees are used for repairing equipment, adding new equipment to the facility and making upgrades to the facilityA sign is posted at the front desk one month prior to the maintenance fee being charged as a courtesy to our membersAs stated above, at time of enrollment, MrsJ initialed stating she was aware of the annual maintenance fee to be billed on April 15, We apologize for any confusion of Fitness 19’s policiesFitness will be working closely with its staff to ensure all members have a clearer understanding of when the annual maintenance fee will be charged and what the maintenance fee is used forThank you for your consideration in this matter
