I understand there are often two sides, or more, to every story I'd like to respond to the claims and accusations the claimant has made against my company. normal;">
The best laid plans often go awry, however in this instance, the entire project and signed contract were based around a preliminary drawing prepared by the homeowner's interior designer Unfortunately nobody (the homeowner, plumber, hvac nor myself) noticed that the drawing was unable to be exactly followed (in one specific location) because of structural constraints with the orientation of the existing roof joistsNot knowing so, the plumber installed their rouwhere originally indicated However, the homeowner felt the location of the bathroom needed to change because of the inability to follow the preliminary drawingI'm not sure how any of this is my fault (I didn't prepare the drawing), but as a good will gesture, I was willing to contribute 1/of the plumbers relocation cost(s) in trade for additional work the homeowner was requesting. Because of the unresolved layout issues, the 3/4" OSB tongue and groove subflooring was not fastened down to accommodate any last-minute changes being madeThe subflooring was always to be fastened prior to the installation of the homeowner supplied 3/4" solid finished hardwood flooring.The claimant being accountant savvy, made numerous changes (mostly subtractions) to the original signed contractThe subtractions reduced the total project cost and draw schedule, only for her to add the items back, without making any compensating adjustments back to the contract Our first scheduled draw was short by $1,because of the above manipulations It was for this breach in contract, we suspended work after giving written notice to the homeowner Unfortunately, as a result of the standstill, I forwarded this matter to legal counsel for further documentation To date, we have removed the original mechanicals, completed demolition (which filled 2@ yard containers), and installed the rough framing and electrical where possible I'm unclear how the homeowner feels a 100% refund (plus reimbursements) is due when work was performed and materials have been purchased and affixed at the property? We are willing to refund the unused portion of the material(s) retainer and the unused labor costs collected My attorney has sent this offer to the claimant and awaits an answer before a settlement/disbursement can be made. At the end of the day, I've known the customer for over eight years and have done repeated projects for herWe would have preferred to finish what we started had the claimant honored the signed contract

If no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted]I am rejecting this response because:F&K construction is misrepresenting the facts.   F&K Construction walked away from the job, and refused to finish it without more money - money that is absolutely not owed.  He already has $15,475 of my money, made an error which cost me another $2500 (due to his complete lack of communication) - which is clearly his fault and his cost to bear (he admitted it was his fault).  The designer was HIS designer, not mine.  He met with the designer numerous times and agreed to the plans, he is the GC and if the plans aren't viable he needed to communicate to the rest of HIS TEAM BEFORE they do work on the project.  He is sadly mistaken about the draw numbers too, he has a big downpayment, materials deposit and the first draw for demolition which is not done (pictures can be provided) - he has the full $4000 (his comments about missing $1000 are just bad math on his part), I never agreed to his revised draw schedule anyway as he left only 1000 as the last draw, unacceptable.  The second draw was contingent upon COMPLETION of framing, subfloor and electric - again, I have pictures and it is clear to all that this work is not done.  Additionally, the subfloor is unsound and would not meet code, I have four GC's who would be happy to attest to that fact.  I have to remediate his work, pull it all up, throw the materials away, and start over.  I am not sure why he mentions work coming off the contract, he pulled the plumbing work of $10,000 out of the contract, forcing me to pay the plumber immediately for work.  He got all of the work back that was in the original contract, I don't understand what compensating adjustments should even be made in his mind, the number is the same as the original less the plumbing that he pulled out.  If his rebuttal made some sense, that would be useful, but it does not.  He literally just sent me a note from his lawyer this morning - he has been sitting on my cash which renders me unable to finish the project (and he knows this very well).  Regards,[redacted]

Review: I'm categorizing this as a "product issue" as the contractor did poor work and then when we agreed to a compromise - a partial refund on his terms - he changed his mind and cut the refund in half. Contractor did several things: one major project - replacing the treads and risers on the main staircase; and several smaller projects: install a railing to the basement, repair basement door, install outside outlet and replace the outlet for the washer & dryer. Overall attention to detail was extremely poor and workmanship was substandard. Just a few examples ... contractor finished the stairs and then decided to bring a structural issue to my attention! Of course he offered to fix at my cost. The top stair tread is significantly shorter than the rest. Molding on stairs looks like I could have done it. (I paid a professional to do professional work, not amateur work). Base of railing was cut as discussed, but left with really sharp edges. Material color was incorrect. (I selected based on a small sample, and specified that it should match another piece. Contractor didnt check and installed anyway. I couldnt be there to check since the timeline was pushed back some.) Basement railing was cracked and post wasnt sanded. Basement door lock wasnt aligned properly. Basement door hinges werent secured. He even charged twice for taxes on materials. I have asked the township inspector to come out and inspect the electrical work that was done. He said Im the first complaint hes had in over 11 years, but Id still save yourself the headache and go with someone else.Desired Settlement: I'm still attempting to work this out with the contractor. I've enlisted the help of [redacted] and their complaint resolution department. Although I am looking to receive a partial refund of $740 (80% on the stairs less balance due), it may be dependent on the township inspector's evaluation of the electrical work. At this time, I'd like to get the word out there and have my complaint posted on the Revdex.com website. Can I enlist your help for resolution later?

I am rejecting this response because:

In my original request, I stated "At this time, I'd like to get the word out there and have my complaint posted on the Revdex.com website. Can I enlist your help for resolution later?" So I'm not looking for Revdex.com's assistance in resolving this matter. Even if I was, [redacted]'s counter of "approximately $220" does not match any of the previous offers, so I'm not sure how he is getting to that number. And it is too low anyway. Also, the electrical inspector found issues with all the electrical work that was done (per the attached report), so I'd like a refund to compensate for that as well. $125 + $150 in labor for work performed plus an additional $75 fee for the electrical inspection - a total of $350 above and beyond my initial request.
