Complaint: [redacted] I am rejecting this response because: Gilberto G***'s statement claims: "The customer was told clearly that he would have to renogotiate the price once his mechanical inspection was done He asked me again if he was going to be able to buy the car for what he offer I said "I'm not the boss, my name is not on the building and that my boss was very resonable and perhaps maybe he would still take that offer." In reality: Gilbert's statement is patently -- and even illogical When manager Jamie left the room, I asked salesperson Gilbert if we still had a deal He assured me we did I clarified three separate times with Gilbert that if I took the car to my mechanic as soon as they opened and no major mechanical problems were found, that I can have the vehicle for $8, He agreed and assured me that Jamie was "an honest man" and "a Christian man" who would honor the purchase price If Gilbert had told me what he now claims he told me, WHY would I have taken the Prius to my mechanic? I would never pay $to inspect a vehicle without a firm agreement on the purchase price first Jamie N [redacted] statement claims: "At 6:PM, Mr [redacted] called our office and said he would like to purchase the Prius for Over the weekend we had sold all of our Priuses except the one he wanted and another that was a different of class altogetherIt had been a busy weekend and we had plenty of room for parking so l really did not want to sell the car for much less then our asking price." In reality: I called them at 3:PM (as documented on my mobile phone bill), which was immediately after my mechanic completed his inspection and called me And on that call I did NOT say I would like to purchase the vehicle (as though this were a new offer), but merely passed on the "good news" that the Prius had passed the inspection and we could now complete the paperwork Again, I would have never taken the car to my mechanic for an inspection except for the salesperson's prior explicit agreement on the purchase price The facts remain: This circumstance was a bait and switch Despite Jamie's acceptance of my purchase price offer and then Gilbert's reassurance that Jamie would honor that agreement after my inspection, they tricked me into paying for an inspection and then tried to renegotiate the price It is possible that Jamie is not aware that Gilbert lied to me, since Jamie wasn't in the room at that point But in my business -- and in all ethical businesses -- employers stand by the promises that employees make to customers That did not occur at E&J Motors Sincerely, [redacted] ***

The facts surrounding the case are true but I would add that I had tried to talk the customer out of buying the BMW before he did then in a couple weeks after he bought it, he had some problems with it, I offered to get involved while he could still return itNow several months later, it is too late, there is a bank loan and other considerations preventing us from doing what we wanted from the very beginningThat being, have the customer keep the good vehicle that we sold him that had no problems at all and was very low maintenance We don't believe every car is for everyoneBMW's have a high maintenance reputation that they have earned We value the customer and saw this comingI did not believe he would be happy with it I will note that the vehicle was sold as-is

I don't know how to respond, we can't force someone to stop a transaction they want to complete. We certainly check to see if the transaction is complete as we need to pay off a customers trade in vehicle and collect funds for the transaction. We don't have the ability to know what the future holds for a vehicle but we certainly warned the customer of our experiences with this vehicle type.

We received a letter of complaint # ***.E&J MOTORS Tuesday September 15, 2015On Saturday, 9/5/Mr *** came to our place of business and offered me 8,hundred incash for a Toyota Prius he had in stockAt the time we had four similar models in stock and no place atour business for our customers to parkThe customer had not taken very much of our time and seemedto know exactly what he wanted so I took the extra step and asked him if he was willing to buy it rightnowHe said he was willing to and I decided to accept his offer.He then said he would set an appointment to take the car to a mechanic and have a prepurchaseinspection doneI told him that it has been inspected by a Prius specialist already but I did not have aproblem with him taking it to his own technicianI also said that my acceptance of his offer wascontingent upon him buying it now (huffing and puffing)I was clear to him that I don't negotiate lowerprices than my list price until someone is ready to buy it.The customer returned about 8:00am on the following Tuesday and took the vehicle to histechnicianAt 6:PM, Mr *** called our office and said he would like to purchase the Prius forOver the weekend we had sold all of our Priuses except the one he wanted and another thatwas a different of class altogetherIt had been a busy weekend and we had plenty of room for parkingso l really did not want to sell the car for much less then our asking priceAfter giving it a little thoughtI countered the customer at 8,It seemed bad form to ask what I really wanted.The customer got other employees involved and had taken the car for an excessive amount of timeIconsidered my offer generousI regret the hard feelings and wish Mr *** wellIt is a good idea tohave a technician look at the cars to just have a second set of eyesWe inspect our cars very carefullybut we miss things often enough that we are not offended when someone wants to have it checked butit is best to mention it before you offer to buy the car "right here and now".Jamie N***ManagerE&J Motors, Inc

I am sure Gilbert knew about that transmission as he knew about the noise and said it was fixedThe transmission has been repaired and I will go on with my lifeJust wanted someone to know, and not get blown off by a salesman

This is the first time I have heard of this issueWe don't do transmission repairs and in this case we would have sent the machine out to an outside shop for the repairWe would require them to warrant this repair to make sure that if it came back, like in this case, I could provide support
I welcome the customer to call me so I can find an appropriate solution to this issue

We don't believe every car is for everyone. BMW's have a high maintenance reputation that they have earned. 
 
We value the customer and saw this coming. I did not believe he would be happy with it.
 
I will note that the vehicle was sold as-is.

This dealer is a cut above the ordinary, in my opinion. I had a few problems with the car I purchased, and they went out of their way to help. I paid a fair price, including my trade-in,

and am satisfied.

They'll try to sell you a car, but they aren't high-pressure or pushy.

You really can't ask for much more from a used car dealer.
