Review: E & B Construction Corporation hired Capital Resource Management to collect a debt. Capital Resource Management asked me to send them a good faith payment of $5050.00 and a punch list of problems that E & B Construction Corporation will correct before they receive payment in full. I sent them a payment of $5050.00 and the punch list with photos of issues that needs to be corrected before they receive full payment. They sent me a Stipulation of Agreement punch list that was different then the list I sent to. They included legal demands in the Stipulation of Agreement. They dont want me to take legal actions against E & B Construction Corporation after agreement is signed. I couldn't accept the agreement because the contractors deviation of construction plans that was issued to me by the town building department. I incurred extra cost by my architect to correct deviation of original plan by contractor. The contractor's negligence to cover the roof properly during a rain storm cost me $12,333.00 in property loss. I might have to take legal action in the future to recover extra money spent due to the contractor negligence to perform work properly. The collection agency was informed that I have supporting documents related to my losses. I sent Capital Resource Management a letter stating that the contractor will be paid in full after the contractor satisfies the punch list that was sent to him by me. Does the collection agency have the right to prevent me from taking legal action to recover my losses? I tried to resolve this matter in good faith with Capital Resource Management. I recently checked my credit report and found that the collection agency reported the debt was pending to credit agencies. I'm having a problem acquiring credit due to the collection agencies unfair action. I need to legally recover my financial losses in the future. Can I be forced to sign off my legal rights to the collection agency?Desired Settlement: I need the job completed before final payment is made.

In response to the letter from Revdex.com dated July [redacted], 2013 regarding [redacted] complaint, please consider the following.

We were hired by [redacted] & [redacted] in May 2010 to do remodeling & alteration to their existing house. We completed the job in projected timeframe; however, [redacted] had not paid us the final balance.

We had exchanged email between [redacted], asking for the outstanding payment .Please be advised, that upon finishing of the project we have not received any complaints that something needs to be repaired.

We have sent many of collections letters by email and mail also .Finally we received a response from [redacted] stating that a lot of items needs to be corrected .Please keep in mind that about these necessary repairs that have to be done, we found out after a year later.

We decided to inform collection agency Capital Resource Management to collect a debt from [redacted]. [redacted] agreed to cooperate with above collection agency and he said that he will pay out owed money to E & B Construction.

Since then we received only a partial payment for the balance owed to us .

As the proof that [redacted] have not fulfilled with the agreement he signed with Capital Resource Management ,we attached summary of contacts between [redacted] and collection agency for you to review .
