*** brought her recently purchased Volkswagen Golf GTI to Four States
Tire & Service in Durango Colorado on 10/14/for an oil change.
At that time the vehicle had 189,miles registering on the odometer.
Upon inspection it was noted that there was ZERO
oil on the dipstick prior to
service and the "Check Engine Soon" light was illuminated on the dash
board. Additionally it was noted that an improper steel drain plug
had been installed on the aluminum oil pan. Upon attempting to remove the
drain plug it would not thread out, instead it just "spun" in the oil
pan, indicating the threads on the oil pan had been damaged at some point
during the vehicles 189k miles. Based upon vehicle records, it had been
13,miles since the last oil change unless it was done by an individual or
otherwise without documentation.
On
10/14/15, Four States Tire & Service staff informed *** *** of the
vehicles status and created an estimate detailing the findings and the expense
to correct the issue (attached). Authorization was given by ***
*** and she signed the estimate authorizing Four States Tire & Service
to proceed with the repairs. At this time *** *** was also aware of
the situation. He was rude and unruly in the Shop Lobby, disrupting
business and bothering other customers yet he did not prevent *** from
signing the authorization to proceed and financial arrangement(s).
The
authorized repair required an oil pan to be ordered in from out of area. Four States staff used a sealant product
around the drain plug so the vehicle could be used until the replacement oil pan
was received and installed. During this
time *** *** could have rescinded her authorization because work had
not been started. She did not. The vehicle was brought back to the shop for
repair

*** expressed problems paying for the necessary repair. She continued
to inform staff that this is the only vehicle she and
her spouse have and she pressed staff to release the vehicle prior to
payment for repairs, which is strictly against company policy. She
applied for *** Credit, but was unable to secure a credit line. At
this time management involved Robert W***, President, in the
conversation. He was empathetic and agreed to release the vehicle to
*** *** provided that she would provide partial cash payment, leave behind
a driver’s license and credit card, and agree in-writing to pay the balance by
10/20/15.

signed the authorization to proceed with the repairs as well as acknowledgement
of the deposit to be paid and agreement to pay by 10/20/15.
All
attempts to reach *** *** on the telephone have gone unanswered. Messages have been left, but calls were never
returned. This lack of contact left Four
States little choice but to contact her at her place of business where she had
been dropped off by staff while the vehicle was in the shop and where we had
delivered the vehicle upon repair completion.
On 11/09/*** *** (spouse) called Four States Tire &
Service's Corporate Office insisting that staff stops trying to contact ***
*** to collect for the repairs and make good on her agreement. He
further claimed that staffs attempts to contact her and collect were done in an
intimidating fashion and stated that they have no intention of paying so we are
wasting our time. *** *** then proceeded to visit the shop location
to further press the issue. He was once again rude and unruly in the
Lobby, disrupting business and intimidating other customers and staff
members. *** made threats to Store Manager Danny P***, challenging him
to "step outside". Four States Tire staff diffused the
situation and asked *** *** to leave
In
summary, *** ***'s complaint has no basis in fact. She was
informed of the vehicle's condition and provided signed authorization to
proceed with the repairs. This signed authorization also included
financial arrangements to pay for the work. The vehicle was repaired and
released to *** *** on her signed agreement to pay. ***
*** has not paid the outstanding balance and is using this complaint to
twist the facts and justify breaking the agreement. Furthermore, ***
and *** *** have expressed intent to damage Four States Tire &
Service's reputation by spreading information about this situation with no
factual basis.
Four
States Tire & Service intends to use reasonable, professional methods to
contact the customer and collect the balance due. This may include
pursuing legal action in Small Claims Court as well as Mechanic's Lien and any
other legal method to collect and protect the good name and reputation of Four
States Tire & Service. All attempts to contact and collect have been
done in a calm, professional matter by responsible staff members who are well
known and respected in the community
Four
States Tire & Service made several concessions throughout the dealings with
*** & *** ***. Parts were
sold at cost to lower their price and the vehicle was released prior to payment
on the signed agreement to pay. Four
States Tire & Service is legitimately entitled to the balance due and does
not intend to negotiate further on this matter

If the consumer does not provide a reason if he complaint will be closed Administratively Resolved] These accusations against me are wrong it just goes to show this company is very unprofessional and harass me very loudly degraded me belittled me and it's all on camera when I am on my husband called the owner to see why his employees were coming into my job he stated they would not do that I have them on camera I have my boss and witnesses customers I am too intimidated and too scared to respond to any more future phone call that's why I have not responded back this company is wrong I did agree to have the work done because it is my only vehicle and I they told me that they would not charge me for an oil change and at the end of the agreement I signed as attached they charged me anyway I do not feel like I should have to pay anymore especially after coming into my work and belittling me and degrading me the company is lying they are all back in each other and I feel it is very unfair very very unprofessional
