Revdex.com:
I have reviewed the response made by the business in reference to complaint ID 11691548, and have determined that this proposed action would not resolve my complaint. For your reference, details of why I am rejecting this response appear below: Designers Choice did not water as stated in his reply We watered on Sunday and Monday because they did not show This was Memorial Day weekend The owner, ***, promised to be on site during the retaining wall construction and work with us to place the stones because he did not create a drawing for his team Because of this, we did have to have some stones moved to accommodate the design intent Rarely did *** or his crew show up as promised They started the job in late April and did not seed until early July; It was actually a very dry summer *** coordinated the pouring of the patio and it was the grade his team constructed that his contractor used to layout the patio *** did not bring in top soil after seeding I purchased yards of top soil directly and it was delivered at ***'s request shortly after the job was started. Regards,*** ***

Dear Revdex.com,

This is in response to [redacted]'s above complaint.

We were contracted to due work on [redacted]'s property and had all intentions of meeting a schedule like we do on every project. But it rained on and off during the first week we were suppose to be there, then...

once on site we were to work with [redacted]'s wife [redacted] to build wall.   Our original contract was for wall, seeding and prepping the beds, so that is what we set out to do, after the wall was built they wanted to add plants to the plant beds, so [redacted] came up with a list of plants, we ordered and delivered for her to set out where she wanted them.

When we delivered them I told [redacted] that we would make sure to water them over the weekend because he was concerned that with them being gone they would die.  I had someone water on a friday, and Saturday.  We planted the plants a couple days after we delivered, and made sure to let [redacted] know we were running behind due to the late start on project and trying to keep other contracts going as well.

I was on site to start most days, not all of them, but each day my team would tell me how they had to move certain boulders and plants several times from the direction of [redacted].  We had no problem with but [redacted] would get home after we had left and not see the progress originally said because we were redoing things that [redacted] wanted done.

To address my communication by text, he is right, [redacted] was not always available to take a phone call, and [redacted] refused to talk to me when I was on job site.

As far as lawn is concerned, we did grade several times since [redacted] would tell us everything looks great then [redacted] would come home and want it different.  In the backyard there was a puddle of water that would not drain very fast, this was due to concrete patio that [redacted] had someone else do, had a low spot so him and I discussed and I told him I would have to regrade backyard or put drain in, he said he was not worried about that.  We also came back after the seeding and put down 8 yds of topsoil and reseeded all areas that were not coming up good, no cost to [redacted].

As far as the warranty issue, I have never told [redacted] I would not honor my warranty.  I did however tell him that I would replace one tree this fall, not because it was dead but had a branch that was dead and would look different until another branch formed and he was going to hold $1000 because he said he was going to hold.  We have at this point replaced some plants that have died, before his letter was written to you.

The irrigation sensor and heads have been replaced as this last Monday.

The other delay was that the builder poured that driveway over the property line which caused us to not finish [redacted]'s work, otherwise other work was done way before the Sept date he is talking about.

To address [redacted] having to redo his lawn, not once did he ever say he was unhappy with his lawn and that he wanted it redone, the next thing I know someone else is grading lawn, turned off irrigation and reseeded.  One of [redacted] and I conversation about plants was that once I noticed lawn being redone I drove by weekly to see progress and to make sure whoever was grading did not hit irrigation, which they did and we replaced and no cost this week, and the plants were not being watered.  I advised [redacted] to make sure plants, especially Japanese Maple, gets water since it looked a little dry.  I only say that because my team did not see anyone water plants when we were on site working and would check in morning to see if soil was moist and a lot of times they were not so we would have to water.

Overall, we do take pride in our work and have responded to the [redacted]'s requests, unfortunately our scheduled got hectic on us and no one wants that to happen.  I told the [redacted]'s before starting their projects because they were concerned about our time lines that two things will cause me to get behind, rain and we had three parade of homes to do.  Well we had rain that caused a late start then we had to pull off to do parades.  There are several factors involved in this job that caused significant delays not only with our schedule but the fact that [redacted] told me [redacted] does not like me and she would only talk to my team.  The problem there is that my team gets direction from me and can not do everything customer wants without approval from me to make sure that is something that we are contracted being paid.

If you should have any questions please contact me.
