May 22, 2015Dear [redacted],
I am writing in response to your letter dated 5/7/15 to explain my side of the story along with some attached correspondence. In addition, this situation has already gone to litigation on the local level and has progressed to the county...
level.Attached is copy of a letter I sent to the [redacted]’s dated 12/8/2014. It contains the notes that we made and kept in our file, an email from [redacted] dated 9/22/14 with a very vague list of items requiring further investigation to determine if they were covered under warranty or not, and a letter from our flooring contractor. These attachments will provide my side of the story.
The letter from [redacted]. provides **. [redacted] with the steps to follow if a customer ([redacted]) is not satisfied with the determination of the flooring representative. Also attached is a letter from my attorney, [redacted] from [redacted], to me, with an estimate that **. [redacted] provided for repairs. You will see that **. [redacted] did not follow the proper protocol that the [redacted] Manufacturer’s Customer Service recommends with independent certified inspectors.
This estimate also listed a material ([redacted]) to replace the aluminum capping on the back porch. [redacted] is a very expensive product which was not included in our contract. Every home built, including my own, will have some waves in the aluminum capping and vinyl siding depending on the temperature because it is fastened to wood with nails. This is a normal occurrence because different materials expand and contract differently with temperature changes.
I have been in business for almost 28 years and this is the first time I believe that I have received a letter from the Revdex.com. My attorney and I have tried to work with **. [redacted] and help him understand these issues. I work hard to build a good reputation and keep my customers happy. I have hundreds of satisfied customers and can count on one hand the dissatisfied ones. As I’m sure your aware, there are some people you will never completely satisfy. We believe no matter what we do and/or say, including our flooring subcontractor and manufacturer, **. [redacted] will not find anything acceptable and be satisfied.
Sincerely,
David B. Himmelberger President
