and I discussed a garage remodeling job on or about October 16, 2017. I asked for a written bid including a start and finish date. I told him I would like the job finished by end of November as a baby was on the way in January.
*** gave me a job estimate on October 24, 2017 totaling just under $8000. It did not have a start or finish date but he told me it was a small job that should take only a few days, or a week at most.
I made repeated attempts to get the job started, and after many calls he said he would make a "special consideration" to begin the job on December 16.
On or about December 16 your crew tore down the garage door and door opener and framed in the front wall, including two windows for which I had paid separately for the materials. On that date *** asked for one-half of the total job, and I gave him a check for $4000. The check was processed by Chase Bank on December 19, 2017.
After that date, I heard nothing further about the job, no calls, no texts, nothing. The front of the house was unfinished, not sealed and exposed to against the weather, so on December 30, I texted *** that I must move on to another contractor to finish the job.
Again, there was no response from ***, and on March 14, 2018 I texted asking for the return of the down payment that was not earned. *** promised by return text that you would return the unused portion of the down payment, but that he needed time due to a sick family member.
I texted again on April 9, at which time he again promised to take care of it but needed more time to get the payment together.
At most, the value of the work *** and his crew performed is $1000; on May 17 I sent *** a demand letter for $3000., via certified mail, but the Post Office tells me he has not come forward to sign for the mail as of May 30.
I am elderly, will be 80 in August, and I live with my *** who is a retired *** who is 100% disabled, a I feel we have been taken advantage of by a local contractor.
