Upon further investigation of Mr***'s claim, it was discovered that the manufacturer of the item in question was *** ***, not *** as statedAgain, as indicated in my original response, *** does not now nor have they ever manufactured the locomotive the claimant indicates was the subject of the dispute. The item in question was a *** *** 2-8-Consolidation which had a price label affixed to it for a completely different item, a *** *** (different manufacturer) caboose (different item) for $49.95, a salient fact which Mr*** fails to mention in his claim. The MSRP for the locomotive in question was $449.99, and in-store our price is $404.98, as all of the similar models Mr*** cites were clearly marked, another fact which he fails to mention in his claim. Moreover, there exists no law in Colorado requiring store owners to honor the prices of clearly mistagged items, and this is clearly such a case. Otherwise, those small number of unscrupulous customers could merely switch price tags on items and buy a ozfilet steak for the price of a box of Skittles. As outlined above, the description on the tag did not remotely resemble the description of the item on the box, and the price tag was immediately changed upon the claimant bringing it to our attentionSurely, Mr*** did not believe that a $item was on sale for $49.95, when every other similar item on the shelf was listed at $404.98. Sadly, this appears to be a thinly-veiled attempt to take advantage of a simple error, and as such we categorically deny Mr***'s claim as erroneous at best and, at worst, fraudulent

Sincerely, I am no longer going to make an issue of this-If this gentleman is going to start throwing accusations out, then it will become an issue. He may be right and I read the information incorrectly, however, I did not once accuse him of anything except what I believed was the case. If he wants to pursue it beyond this have your agency contact me. However, as stated above, it is time to move onto other things. I wish for caboose hobbies, the very best.

We are confused and concerned about this alleged issue, as there is no such merchandise ([redacted] 2-8-0 Consolidation, Rio Grande) in our store, nor has there ever been. Moreover, the manufacturer does not currently nor has it ever manufactured such a model. Perhaps the customer is...
mistaken about the identity of the product in question? We would happily address the issue if provided valid information. Lacking this, we question the legitimacy of this complaint, and respectfully request that it be removed.
