contractor has submitted a final invoice for 100% of the contract value but has not completed all contract work. Contractor insisting on payment.
Contract states the pool is complete when plaster is completed. The plaster has been installed but unfortunately, contractor has not installed the pool cover inserts, delivered the pool cover, provided the required warranty information or provided any demonstration and training on the pool equipment. In addition, contractor left the site without restoring the area around the pool back to it's original condition. I have told the contractor I would pay him when he completes the pool inserts, delivers the pool cover, provides the necessary training and warranty documents. I am currently in the process of completing the work to restore the site to it's original condition and have told the contractor that I would do so without his help.
