Bayview Home Services & Remodel Response • Jan 27, 2020

Hello *** and thank you for reaching out. We are a small handyman shop that consist of my wife and I, and we work out of the south side of Milwaukee. We completed two previous jobs for *** over the last 6-8 months of so, to her complete satisfaction. The first was a faucet install where I came back twice to adjust her water temperature and I was happy to do so. The second was a dog kennel build that she was happy with upon completion and even tipped us for our help. In recent communication to fox 6, she mentioned that we had to get to a boat ride that evening and this is true. *** captain s a boat during the summer so he did have another job at 7pm that evening. That being said, we completed the dog kennel in time using all of the material-- Since *** dog weighs over 130lbs, , *** had even offered to come back if she wanted to get additional closers for the fencing. Since she gave us a tip and inspected the work, I could only assume she was satisfied. We installed two windows most recently and upon completion had her inspection of the job. She was satisfied that day. About 3 or 4 days later we texted to ask if we left a tool behind at her home. Her reply was that she was not satisfied, but then added some personal jabs that were disrespectful as you can read for yourself in the text communications that we have attached. She was angry and attacked us personally. Being in customer service we understood that sometimes emotions come out in harsh ways. We responded respectfully asking what the issue was and when we could set up a time to return. She had requested fiber glass insulation even though the mfg recommends you not use that- both windows were fully sealed and insulated with caulk as per mfg specifications, however, we were happy to comply with the request. We also agreed to paint the window stops and address any remaining issues upon our return. She replied again with some snark and additional hurtful comments but did give us a time to come back, which we agreed to. I believe it was for a Tuesday or Wednesday at 1:00 pm. We agreed and planned for that day and time.On the day she was scheduled we texted at 12:41pm that we were wrapping up a small job and would be On our way in 15-20 minutes, putting us at her home about 1:05-1:10pm. She replied that she wanted us there at 1pm, and began accusing us of being unreasonable and breaking our agreement, she left a message and accused us of shotty work, you will see part of that message transcripts and attached etc. She also stated that this was not acceptable, again, which can be read in her words on the attached text copy. Since she stated that this was not acceptable and we were unreasonable and accused us of shotty work she implied that she no longer wanted to business with us. We felt intimidated and with her comments about our work and her statements and we felt unwelcome. We felt comfortable with the level of quality of work completed and considered this case closed, she would rather work with someone else in the future. When we set the job up,*** was looking for additional cost savings & I had communicated with her that because the installation was more involved that we couldn't do the job for less than $450 for both windows. At no time did I pressure her to do the work of to work with us as you will see attached. We talked and texted that 1) The glass block window would need to be built in since they are unable to cut partial glass blocks. *** had asked me at the time if she should pick the wood up for that piece of the project. She also called me when picking up the window to confirm the size of the window and the size should be smaller vs bigger. I confirmed on the phone that we needed the smaller window & a that a larger window would put us in trouble, as we were in no way going to cut a larger opening into both her home and siding to create a larger opening. Building glass block in with wood framing recommended 2) The double hung window needed to be installed into a n angled corner and the wood paneling needed to be removed. Additionally, *** had to cut custom wood stops on-site for both windows. To save money, *** agreed to pick-up the windows and have them ready for us. I was miffed when several days later, she complained about my two girls being present. We are very clear with our customers that we run a family business and that at times our girls are with us. I am also Very respectful of our customers and let them know when this is the case. *** had indicated to me that this wasn't a problem and it hadn't been in the past . I had to bring the girls back with with me after school because by that point *** was finishing the installation and required my help transporting the window from *** car to the opening. The girls were present for no longer than one hour.I respect that consumers can go to a third party to review a situation for a fair assessment of the situation to identify if there were parties who were short changed or parties who had done wrong. Fox 6 has heard both sides of our encounter and sent me an email that after hearing from us, they would not be pursuing a story or further action. We had offered with fox6 to go back with them (camera crew or producers) to *** home to continue the conversation and see if we could come to resolution. They declined to pursue the case further but thanked us for our time and for our professionalism and for detailing our experience with this customer.*** crossed the legal line and committed libel by publishing online that we are committing crimes by stating that we "prey upon the elderly and the disabled. ". Those comments directly affect our business and are considered liabless. Although it is unprofessional and discourteous to call people names, making serious and false of accusing someone of committing a crime by claiming they are "preying upon the elderly and disabled" is serious and illegal. "Under the federal defamation law, section 230 of the communications decency act regarding internet defamation, summarizes that personal opinions of somebody's character is protected free speech under the first ammendment of the constitution. HOwever, publishing or broadcasting an unprivileged, false statement or fact about another person with or without mallice, that cause harm to the reputation of said person or business is NOT protected free speech and is in fact against the law. ". (Siting *** internet lawyer s, sic.US constitution). I have attached *** comments from facebook. This is above and beyond a customer who had a negative experience, this is considered by law defamation per say and an attempt to take down a business with an otherwise unblemished, untarnished reputation that we have worked hard to achieve. We have requested that Facebook remove all of or that part of her written statements. We would also ask that the Revdex.com requests the customer remove any false claims against our business on any websites where these false accusations were made. We are currently researching any additional reprints on websites as our attorney has instructed us.We are a gold cup business winner in our neighborhood and won "favorite" business by our customers 2019. More than half of our customers are elderly and We have done lots of work helping disabled on projects such as building custom wheelchair ramps and installing stability grab bars to make a few. Every single review of our business has been positive with the exception of this one and a similar one where we were successful in proving that false statements were made. The facts, *** written statements and the liable laws back up our request.Due to the harrasing and false nature of her statements, we chose to end direct communication with her. I have attached all text communications between ourselves and *** for your review. We upheld the contract she agreed to and worked above and beyond at no extra charge. At no time in person did she have any issue with this project or with us . Our offer still stands that we will meet with a neutral 3rd party present at the customers home to do everything in our power to correct any perceived defficiencies. We do not feel safe or comfortable dealing with this person alone. Please let us know and we'll be glad to meet you there. My name is *** and you can reach us by e mail anytime that is convenient for you or your staff.Respectfully yours;Bayview Handyman I agree to release the above company to provide my personal information to FOX 6 News *By answering "Yes" Contact 6 will be better able to help resolve your complaint. YesI agree to do an on-camera interview should Contact 6 pursue my story. *By answering "Yes" Contact 6 will be better able to help resolve your complaint YesPlease explain your problem accurately Special ordered windows were measured incorrectly. They put them in by using unfinished scrap wood and caulk. The glass block should be grouted and there should be no window stops used on either window. *** said put them in on the the inside so he doesn't have to mess with the outside of the house (aluminum siding). What are you seeking from this company? Finished windows properly installed or reimbursement for windows and labor.Attach copies of receipts, warranties or other important documents *** -- Why do our customers keep coming back? "Our business is only as good as our work and our word. We enter all agreements honestly and with open communication to customers and suppliers This is the cornerstone of our business. It provides for fair pricing, quality workmanship, and satisfied, returning customers".
