The resolution presented by the business in their response is not factual. The boat has been returned to the dealer two times for the contract to be fulfilled. The first time the dealer kept the boat and said it was fixed. The boat was returned a second time July 29, 2015 - Took boat back to Smitty's. The owner (referred to as Smitty) was there with Todd [redacted]. I told him I'm done with this boat and he said "that's what I heard. Why did you have to file with Ebay?" I told him that this is the second time I had to bring the boat back and it is not what they said it was. I asked that they refund my money and he then told me that he doesn't have to "horse with me" and I should go to the Revdex.com, start a law suit or whatever I need to do. He then got in my face and directed me out the door saying "you need to get the [redacted] out of here now." I returned home with the boat that is still not running. The contract has not been upheld for the purchase of a boat in excellent condition.
The only acceptable resolution at this time is a refund of the $10,100 I paid for the boat as the boat does not meet the description on the auction. The boat is not in excellent condition at all. The locking storage does not lock, the vinyl is peeling, and the motor does not run. I have already lost enough money in this venture and still do not have a boat that runs. I have given the dealership ample opportunity to meet their requirements of the contract and they refuse.
